I went on a trip to Detroit by car recently, and was detained at the border.

When I arrived, the guy at the booth flagged my car, and told me to pull over. I did so, and then a border agent YELLED at me to put my keys on the dash, and to leave my cell phone in the car. The way he yelled at me was as if I was a criminal. I mean, I was shocked. Keep in mind that I have no criminal record.

The guy inside was much nicer and asked me in a civil way some further questions, and I was free to go.

HOWEVER, the reason the first guy ordered me to leave my cell phone in the car was so that he could search it for any signs of wrongdoing. After doing some research, I found out that BORDER OFFICERS HAVE THE RIGHT TO GO THROUGH ALL ELECTRONIC DEVICES EVEN IF THERE IS NO SUSPICION OF WRONGDOING. THEY CAN GO THROUGH YOUR EMAIL, MESSAGES, CALL HISTORY, AND WEBSITE HISTORY.


Luckily, I had a pass lock on it. Otherwise, I could be sitting in jail now. Besides visiting terb, and asking about prostitutes and services, they can see my entire history of posts, since I remained logged in.

Also, I did several searches on highly illegal activities. HOWEVER, this does not mean I ever committed or would ever commit any crimes related to those searches. It was mostly out of curiosity. However, if border patrol had seen those searches, all hell would have broken loose.

Don't EVER cross the border with any kind of information you don't want border officers to see on any electronic device (cell, tablet, laptop, camera). They have the right to search it, and even confiscate it!!

Also, always apply a pass lock on all devices.

I think it's completely wrong that I was treated like a criminal for simply crossing the border. The officers was a power tripping asshole. They have no right to go through my phone and see all my private information. How can this be legal??

Yup. As a rule I clear my history and cache for any border. As well as any conversations, even with buddies where the hobby is discussed.

Its legal due to the Patriot act I believe.

Good advice.

Keep a pass lock on your phone at all times. Not just for border searches, but if you lose your phone in a pub you will rest easier knowing whoever finds it cannot access your private data.

Get used to it. And what`s worse, (as I understand it), is that if that ONE INDIVIDUAL OFFICER deems you inadmisable for entry to the U.S., there is NOTHING you can do about it! There is no appeal! His/her decision is final! WTF? Welcome to the new post 911/U.S. Department of Homeland Security Patriot Act police state b.s. we now have to deal with when crossing the `world`s longest undefended border`. Also keep in mind, when coming back to Canada, that our own (and someone correct me if I`m wrong, and I hope I am..), INDIVIDUAL CBSA officers also HAVE SIMILAR POWERS AS U.S. OFFICERS of search and seizure....(BTW, I also had very similar experience when crossing at Cornwall into N.Y state couple of years back. I was ordered out of my car at the booth, (wasn`t even allowed to park it for Christ sakes), escorted into the office by 3 armed officers, they searched my car, I had to empty my pockets, they went all through my wallet, etc, had to answer detailed questions about where I was going, who I was going to be in contact with, all this just for a stupid one week vacation to New England???....they eventually let me go, but get this, I DIDN`T EVEN HAVE ANY ELECTRONIC DEVICES WITH ME!! That`s right, no cell or laptop! So...I dunno, do they google your name? Or where they just being power hungry jerks?

Yup. Under most circumstances, any type of search and seizure by police would require a warrant signed by a judge; border guards/customs officials are not bound by any such requirement.

Their job and the fact that they have guns give them a big ego. They are power tripping Americans. They can do whatever they want and you can't say a word or the big power trip will start. I haven't been across the border in over 6 years and will never go back.

I'm only half kidding, but is it possible that some of you are just a little sketchy looking? Be honest...

I don't even know OF anyone that this has happened to and I sure as shit don't ever get yelled at?!?!

Maybe I'm just a sunny side up kind of guy, but I don't think border guards act like that for no reason at all

Only time I ever clear the history on my phone is right before leaving the country .

Just wondering though, do cops have the same right to search your phone ?

No reason was given at all. They searched my car and had a dog sniff my ass.

As the link you cite points out it is legal because the courts have consistently held that the government has heightened powers to protect the national security at the border and this includes suspicionless searches of electronic devices.

Bottom line don't take a laptop or cell phone that has incriminating information on it across the border and clear your browsing history and caches.

Amazingly enough Joseph and Jane Average Citizen, are far more concerned about stopping people at the border who may pose a threat to them, than worrying about the fact that the Border Protection Officer might discover that you are a TERBite.

Now do I believe that some U.S. Customs and Border Protection Agents behave like complete horse's asses you'd better believe that I do!
