A law society approved specialist could run you $300 an hour.

Most lawyers with a practice handling household and property issues should offer a flat rate including powers of attorney for $250-400. Phone around or speak to someone you know who was happy with a property purchase, lately.

I thought you can do it online or download a kit and then just get a notary to authenticate it.

In Ontario there is no need for a notary to validate your will. You just need 2 proper witnesses to do what is commonly called a holographic will. You don't even need the kit, although some of them help keep things organized.

The good part about having a lawyer do it, is that they make good witnesses as to your testimentary capacity and tend to store a copy securely.

ya - that's what my uncle did. His kids and ex are still fighting over it in court 12 years later.

Which also helps to avoid the “suddenly discovered will” which leaves everything to your third cousin once removed.

* This sort of attempted fraud (false wills, and destroyed wills) takes place quite regularly

so aside from having it written out how you want your wealth, property split with surviving family members, what is a will really good for?

Will the government actually eat up your bank account and property if you don't have a will? Wouldn't it automatically go to your wife or husband first, then maybe the children if neither are alive?

a) Your estate may not be distributed the way you would like it to be

b) Even if it will be distributed the way that you wish, it generaly takes longer to settle the estate

c) You have no say over who will be the Administrator of your (intestate) estate, while you can appoint someone (with provisions for sucession if those higher up the list are unable to do so) in your will to be the Executor of your estate.

1) If for instance I'm appointed the Administrator of your 'estate' while I certainly have a fiduciary responsiblity to administer the estate honestly (which of course includes not looting it), at the same time I have no obligation to try to do everything in the least expensive way possible nor to reject just compensation for myself. Your Executor on the other hand particularly if they are a relative does aways have in the back of their mind that they are taking money away from the (other) heirs.

when your lifes assets are at issue, you should spend some $$ and have a will professionally done IMO. A lawyer that specializes in wills & power of attorneys will have some good suggestions, and they will also take notes besides the will so that if ever the will is contested , they fall back on their notes they made with you. could be the best spent few hundred dollars ever.

A DIY will is like treating your relatives as rabid dogs and throwing them raw meat at your death. Anyone serious about manging their estate should involve a lawyer in the preparation of a will.

Doesn't a holgragraphic will have to be written out entirely by the person making it?
