I take the government side, and your side too. A SIN number is completely optional. I learned you NEVER have to give it unless under very specific circumstances, and I am judicious about it. I have a unique name and can easily be identified by it, unlike someone named John Smith. However, someone is completely with their rights to refuse to give you service because of your denial of a SIN.

Therefore it is simple, if you don't have a meeting of the minds on a SIN number, no deal is done. Simple as that. She'll get another apartment, he'll get another tenant.
Except not. Like in almost everything a landlord does, acting as the above leaves a landlord in a very butthurtable position. I am kinda amazed how many landlord actually think they still own their properties in this day and age. Probably the same sort of people who actually believe the veterans died for our freedoms.

Arrogant? It's called business, we minimize our risk. If the cycle changes, I still do the same thing, been doing it for over 35 yrs.

What are you babbling about? It's simple, we ask for it, if the prospective tenant doesn't want to give it, that's fine. Move on to the next property. I've been in the landlord business for many years and flipped many properties. When you sell I assume I'm the owner and not the government, lol.

Surely, this must be a violation of at least a couple of hundred of the tenant's constitutional rights. Tenants in Ontario have almost as many rights as a Canadian born terrorist.

unfortunately rock as i have noticed after a few months of looking, most landlords don't give two flying fucks about the tenants it's all about the buck. seriously looking for an apartment sucks. i have been blessed this year to have a nice landlady she is truly one in a million. the people i've met during my search saddens me, i am thinking on moving back up north where there is still a hint of human compassion, friendliness, and community.

Passport would be perfect to meet the agents Id requirements. As others pointed out, don't need a SIN# to do a credit check, just name and DOB.

Yes, a passport or perhaps a bank statement or utility bill that proves your identity. The SIN# per se is not needed, but most SIN cards will prove a person's legal name, and that's what they need to establish in order to enter into a binding contract down the road.

i've never used one cheque from my account it's always a direct deposit form that way they know it's coming out on the day it's owed and right in to their account no late payments

I've been on both sides of the tenant/landlord fence and landlords do get burned by destructive and/or non-paying tenants. NOW magazine did a story about "tenants from hell" recently as have our newspapers from time to time. Plus, the law is biased in favour of tenants.

You are absolutely right, a realtor has no right to ask for the SIN number, especially never over the phone.

In addition, realtors do not even require your SIN number for conducting the credit check for a rental. You simply sign a form authorizing the landlord to conduct the credit check at your own expense but no SIN number is ever provided.

In addition: the FINTRAK regulations NEVER require SIN - never. Someone here stated that it was normal for realtor to request SIN for FINTRAK purposes....NO NO NO. Even the FINTRAK people will tell you this is false and misleading. FINTRAK only needs your driver's license or health card, passport number written into the form. That's it. That's all.

You did right to follow your instincts.

all i know is what i'm experienced since i've been in toronto i have had 3 apartments 2 good one bad {the bad one being the moldy hole}. i took her to the landlord & tenant board she had some pit bull lawyer who intimidated me in to dropping my claim case, loosing me about a grand in lost belongings and fines i wanted the board to collect. in the end i had to sign a hush order and the city deemed the apartment unlivable and ordered her to do work to correct the issues.
in all fairness i'm not asking for the world i just want some where to sleep eat and go to work from{i mean work work not escorting} all i keep running in to are brick walls.

Landlords have every right to ask for SI number. Tenants don't have to provide it since it's optional under federal law. However, landlords have to check out the tenant and if a tenant can't provide any appropriate ID for landlord's to do a credit and/or other checks, then the landlord has the right to reject the tenant. There are so many dead beat tenants out there today that landlords are tightening up their checks and rightly so. Many prospective tenants don't have a driver's license, or at least claim not to, or any other appropriate ID to do a proper check so we resort to SI, if they can't give it than no go. The landlord has every right to reject a tenant if he/she can't determine the credit worthiness of a prospective tenant. Try doing a credit check on someone with the last name Chan, Mohammed, Smith or Brown, Khan, Rossi, Cruz, etc... with no proper ID. I was burnt on this over 30 yrs ago and it won't happen again.
