Yes, Oagre, but presuming one can get it into evidence there is the video to collaborate that.

I'm not saying Oagre that you have to have it bring charges or go to trial, but I do believe there would be a problem getting a conviction without further evidence than the victim's testimony.

I was responding to his Texan law quote 'punishment is abusive if it causes injury', ergo evidence of injury as in pictures.

You're right though, assault need not cause injury for it to be a crime, generally-speaking, but there's that corporal punishment wrench thrown into the argument.

According to the judge, the reason his daughter posted the video; "Just prior to the YouTube upload, a concerned father shared with his 23-year-old daughter that he was unwilling to continue to work hard and be her primary source of financial support, if she was going to simply 'drop out,' and strive to achieve no more in life than to work part time at a video game store," Adams' statement said. "Hillary warned her father if he reduced her financial support, and took away her Mercedes automobile, which her father had provided, he would live to regret it."

Why would the video not get into evidence? Under Canadian law, it was a consensual electronic recording. The daughter "consented" to it being taken.

In any event, Mom has followed the primrose path of Karla Homolka and told the media that she was "forced" to participate by dad. If the Limitation had not run out, I presume she would be giving accomplice evidence for the State.

1. The wife admitted that he beats her too. and you can tell she's forced into the whole scenario with beating her own daughter. you can tell the wife is deathly afraid of him. Point is: its not the downloading that's the reason he's beating her. That's just simply a scapegoat. He's just using 'downloading' as an excuse to beat his own daughter. Why? Because right after he beats his own daughter for 'downloading', he moves on immediately to beating his own wife for forgetting to put the lettuce in his sandwich. He just makes up the excuses as he goes. Who knows how many excuses this guy has for beating up his daughter and wife.

2. When watching the video, I could barely refrain from expecting the guy to suddenly jump on his daughter and try to bang her. Im 99% sure the guy had a huge hard on from the whole getting to beat a female with a belt sadism scenario. Its obvious he gets off on it. Does it to his wife too in the bedroom also. 99% sure.

Yeah, I caught that too: The wife is afraid of the husband. He comes in all angry and the wife deflects his anger to the daughter with a big defensive statement, "I didn't want her to do it / she did it all by herself / I agree with you", you can hear fear in her voice as she says that.

No proof, but if I had to make a bet, I bet he beats his wife too.

you bet? its a guarantee he beats his wife. How else do you inflict such fear in a person? threaten to take away the credit cards? you can see in the video how the wife is always maintaining a safe distance from him and she's even so afraid, she'll even pretend to cooperate in the beating of her own daughter. Any normal mother would be holding the husband back and keeping them both apart so everybody can cool down. but the mother knows if she tries to hold the husband back. she'd get the belt too.

its obvious the mother has experienced being beaten before. maintaining distance and saying everything he wants to hear. such as, "I agree with you. I agree with you." is proof of that.

The practical reality is that in this sort of case in a jurisdiction with a "right to discipline law" you need to be able even as the Texas Attorney General's Office stated (see #105) to so prove or else you are never going to obtain a conviction.
of of the Texas law defines the threat of bodily harm as an assault , he threatened to no only spank her face, but to "wear her ass out"

Well, speaking on behalf of the Family Court system, it ain't "broken" in Ontario where most of the judges and lawyers are dedicated and sensitive professionals. Texas, I'm not sure about.

I didn't say ALLLLllllllll judges/lawyers were "broken"....just some :p Everybody has a different perspective of a story...without gaining all the information from all sides...you can't very well get the full picture to make any judgment..unfortunately there are a few who are more concerned with other things, such as money, time, being tired or just pissy with how their day was...we are all human and no system nor anybody is perfect. Not anywhere, Canada nor the U.S.A... the system is broken everywhere...I know this because I have studied this :) Please don't take offense and think/say I was talking about you personally . I am well aware and have spoken to MANY who work in the Family Court System and I can tell which are the sensitive and dedicated ones ..as I am one also♥♥

that is just ridiculous... five-year statutes of limitations expired my ass. A crime is a fucking crime. When evidence is found that someone killed another person, regardless of how much time has passed, the criminal is charged!! Why is assault on a young girl any different? There is no better evidence than video... its not like too much time has passed that the authorities cannot go collect fingerprint samples etc. Its not fucking needed in such a case. Our justice system can be wack sometimes.

Mom could have called Children's Aid and the cops and fled to a Women's Shelter. She made the choice to stay and be an enabler.

Well, rest easy. In Canada, there are no limitations statutes on serious crimes. Up here, judge Adams would have the humiliation of being tried and sentenced by one of his colleagues. And I can guarantee you that the sentence he received would NOT have been soft because of his status. When a judge screws up and "lets down the team", the other judges make a point of showing their displeasure.... in the most painful way possible.

That was an awful, awful video, I felt sick watching it. Especially now I know that the daughter has a disability. Clearly the guy is a raging psychopath who should be immediately disbarred and dismissed from any position of responsibility whatsoever. I guess he wont be charged because of the statute of limitations that fanofdo linked to above which sucks. At least his career will hopefully be destroyed and this is the only thing that people remember about him.

I'm not a parent, nor do I especially want to be in the near future, so I don't know much about disciplining kids, but I think it's pretty clear that that video was abuse. Everything about it, from the psychotic threats, to the repeated lashes with the belt was abuse. I do think, in some cases, corporeal punishment is justified, but that's not what that was. A spank to a bottom of a kid whose misbehaving repeatedly is warranted provided the mother/father is clear about why they're doing it, and takes a step back, gets the worst of their anger behind them, and then administers the smack in a calm, rational manner. Never out of anger or hate, or frustration. Which clearly was the case here. It's a bit of a slippery slope, and on the whole, I would say avoid the issue completely by finding more productive ways to discipline your kids. And the mother is every bit as culpable as the father. Being an enabler of abuse is just as damaging and cowardly as being an abuser, IMHO

Because the Texas Legislature acting on behalf of the people of Texas and with the concurrence of the Governor of the State (popularly elected by the people of Texas) enacted a law establishing statures of limitations for various crimes.

Statutes of Limitations have not been handed down unchanged since the Middle Ages or even from the mid-nineteenth century they are looked at on a fairly regular basis, and occasionally changed and not by courts but by legislatures. Those legislatures attempt to balance justice and fairness: do we want a system where the Crown/Government can wait decades to charge and bring a case to trial - that stupid thing that you did and police knew all about when you were 18 and at 60 they decide they don't really like your attitude and charge you with it, and crimes like murder considered so heinous that when the evidence finally comes together at 60 it is seen as proper that you can still be charged.

I don't believe there is a statute of limitations for murder. And while this Judge may escape any charges due to the Statute of limitations, this case is getting a lot of publicity, so who knows there may be a movement to change those laws.
