If the Feds make prostitution a crime, could Quebec opt out? I can't imagine the Quebecois putting up with such a law.
Wouldn't it be kinda like opting out of Canada?

Actually, the main reason why this wasn't focused on or really discussed is legal precedent and scope. It was previously established by the SCC that prostitution is to be legal in Canada. Furthermore, it's not within the scope of this court to revisit that decision.

That would required another challenge, from the Abolitionists, and it would have a long path that SPOC has already travelled with this challenge.

Also, this type of challenge would fail, because it would be made on moral grounds and outdated studies. New emerging evidence suggests there are more intelligent educated happy hookers rather than the drug-addled street urchin.
I thought prostitution was legal, because there was no law making it illegal; when and why did the SPoC get involved?

Given the questions that were asked of the Government's lawyers from the bench, it would seem a natural follow-up to any number odf the weak answers simply to have asked, "If your purpose was to discourage and eliminate prostitution, wouldn't making it illegal be more efficient?"

That of course would be rude and amount to the the jusdicial branceh telling the executive how to do its business; we know only Reform MPs are so know-it-all.

Given that prostitution is legal I'm perplexed at the concept of anyone—certainly not 'Abolitionists' using a Court challenge to have it made illegal. Not the way I understood our government to work.

You sure about that Perry? Doesn't the Supreme Court have a record of the appeal? Appeal Courts most certainly have the trial transcripts. I'd be surprised if the Appelate Court hearings aren't transcribed as well.

Prostitution is legal.... its the bawdy house thing that gets people in trouble.

And that stems from laws..where whore houses were established..and men..and booze..and fights..and needles...and condoms... and shouting matches..... were happening... in good neighbourhoods...which caused the bawdy house laws to come in. Not to mention the Asians enslaved within these places....

Im alright with bawdy houses...but they have to be somewhere remote...like vegas....hard to make em work in the city!

Very rare. Either oral judgment and reasons are delivered from the bench at the conclusion of argument or judgment is reserved and nothing is released until considered judgment is issued.

CBC had a segment on the radio the other day basically championing the nordic model, decriminalizing the women, criminalizing the men. If the law is struck down my bet is that's what the government will do. I can't see a conservative government either leaving it be, or opting for full decriminalization. Since the problem with the current law is that it endangers the women criminalizing only the customers would seem to avoid the legal problems that (may) make the current law unconstitutional. At the same time.. that will suck.
I recall that this prediction was doubted around here three years ago.

In a financial transaction it is utter DISASTER & will be a complete mess in the courts & socially to keep decriminalized the offering of sex for money BUT criminalizing the purchase of. Just think about that.
