He was taken in and recieved the forms. He blew 90 and 90.

Can anyone tell me if they have experience in court with these charges.

He was only charged with OVER 80.....NOT impaired.

It was a spot check.

What will his 'best case scenario' be?

Just lookin for advice

Im certainley not up on the legalities, but I think you are legally impaired with a reading over .080 , so I'm not sure that "he was only charged with over 80" is a benifet to him.

what courthouse is it going to? In many jurisdictions you could get it dropped to careless if it's his first offence

Mississauga...Careless??? you mean no Criminal conviction? Is that true?
It's most certainly true. Brampton courthouse is one of the worst, but it's still doable. PM me for details.

And what would someone pay to have a lawyer try and work a Careless conviction instead of the Criminal charges

Hopefully "your buddy" gets his license suspended for a significant period, serves time in jail and faces insurance premiums that he can not afford.

That's just my opinion of "the best case scenario".

and now.,..to bring the topic back on line..What would my Buddy have to pay a lawyer to represent him, while he remains 'innocent' until proven guilty!!!

I'm not sure on the impaired but a Traffic lawyer charges $1200.00 for a Stunt driving charge,You will be looking at a breathe interlock for your car when you get your license back,over 80 carry's the same penalty as impaired. A person could be over 80 and not impaired,usually you get impaired if your falling down stupid drunk,in which case you are charged with both.

Call one of those Traffic Lawyer places,the first call is free and if they can do something for your buddy then they will ask for money,they were very up front with my son and when they took his money ,they beat the charges.

A lawyer will charge upwards of 5 grand to defend someone on a DUI charge AND there are no guarantees. IF your buddy gets convicted tell him he might as well give up driving for a few years. Besides the year licence suspension he'll automatically get, when he does get his licence back most insurance companies won't touch him and those that will will charge him something like 10 grand a year for basics. A friend of mine got convicted about 12 years ago and his insurance company wanted the 8 grand to take him back and before his conviction he had a 6 star rating with them.

Once you're charged with a criminal offence in this country you're f*cked. This "innocent until proven guilty" is only a distant memory.

Being able to prove your innocence = how much time and money you have.
