I am planning to file a divorce, any idea how quickly I can have divorce and remarry again with a gf whom I love from my heart? looks quite long process in case of friendly divorce....
any suggestion?

Having never been married, I don't have any first hand experience on this matter, but I am curious as to what your relationship is like with your current wife. I would think that if the two of you are capable of maintaining an amicable or "friendly" divorce, then I would assume that the process can be made relatively painlessly and quickly.

Of course, things can get quite drawn out and complicated if you and your wife have significant issues related to alimony, joint property, custody of children and other potential minefields. My suggestion is for the two of you to negotiate the terms of the divorce (either by the two of you, or through your attorneys).

In a best case scenario when both parties agree on amicable terms, the divorce could be finalized within 3 months. Last time I checked though the law requires for spouses to be seperated for at least 1 year before filing for divorce (during that time you can both still live under the same roof).

What he said. You can file for the divorce immediately and move for the order after the 1 year separation date. If you are really in a hurry, you can accuse her of adultery or cruelty and ask for the divorce right away.

If there are kids, the judge is required to ensure that there is a support provision in place and appropriate custody arrangements before granting the divorce. You and your soon to be ex can work these out in a separation agreement and append it to the divorce to save time and money.

I think you can claim adultery if you have yourself if that speeds up the process any. I've been divorced twice (slow learner) and the best advice I can offer is to sit down with a good family lawyer and go over all the details of your exact situation. The few hundred dollars you will spend doing that will be worth every penny. Any advice you get here will be limited and not specific to you and your situation.

My divorce was granted four months after the application was filed, as I was able to sever the divorce from the corollary relief (discuss this with your lawyer). I had lived separate and apart from my spouse for over one year, and made clear to the judge that the spousal and child support I was willing to pay exceeded the guidelines. The final and finer details of support, etc., were hammered out after the divorce had been granted and I had remarried.

I posted the reason why long time ago.
Here it is:
1.The spouse does not need to be there.
2. pay lawyer 500 USD and he will have it done for you by 3pm that day if you appointment is at 9am.
3. By the time they send papers here it should take 3 months.

As for the other details such as alimony, child support I don't know and the DR people never told me the situation.
Double check this info you plan to do this.

Forget about Cuba-getting an easy divorce there for a foreigner is an urban legend.
DR works nicely but there is a caveat: both parties have to agree to a amicable divorce and the separation details have to be hammered out before. That beaing said, lawyers and judges in DR are notoriously corrupt and for a fee you can get an easy divorce even if your soon-to-be-ex-spouse doesn't agree to it. It'll take 2-3 days for the divorce to be officially final and then you can simply file the judgement in Canada who will recongnised it. If the newly divorced spouse wants to contest it, she has to do it in DR (good luck, it's not an easy undertaking).
Alternatively you could also do it in Haiti; there you don't even need your spouse to agree and she doesn't even need to be present. On the other hand, it'll be a challenge to get anything done in the current Haitian conditions

I just wanted to get general information from experienced persons before hiring lawer. Lawer interest is always in long process, not in quick and short process.
This is very disappointing that even if both parties agree on all issues, no kids, no domenstic abbuse incident and simply want friendly divoice ASAP, still both need to wait a year?? Is this law?

A divorce is only recognized in Canada if either of the 2 parties has a significant connection with the granting jurisdiction. If you fly to Cuba for a week and get a divorce, no Canadian court or public official will take it seriously and they will mock your foolishness for wasting $100's of your money on crap.

For fuck's sake, go talk to a lawyer before spreading this crap.

You are correct if this thread was referring to USA as this is a legal requirement in most states. Canada will accept a foreign jurisdiction ruling on the matter without questionning. Canadians can get divorce in any jurisdiction they want (same goes for marriage).

No. A divorce from another country is only valid in Canada if, when you obtained the divorce you had a "real and substantial" connection to the place where you obtained the divorce, or you or your spouse had been ordinarily resident there for more than a year at the time of your divorce.
