The Pre-Nuptial Agreement "is toast" and became such the moment the mistresses started coming forward. There are many things a Pre-Nuptial Agreement can do, however, one of them is not shielding you from the consequences of adulterous affairs.

It may not be popular here on TERB, but basicly you cheat, you loose particularly when you have made a ton of money during the course of the marriage.

Not the rule in Canada where a pre-nup is not affected by adultery. Canada tries hard to make separations purely "no fault".

A sad story. A friend of a friend married the girl of his dreams while still a moderately wealthy lawyer. In the course of the marriage, he hit the jackpot when a client paid him in mining company stock which went through the roof BIG-TIME-PLUS!! The dude became worth over $100,000,000!

Being a lawyer, he had previously had the lady sign a stingy pre-nup and made sure it was ironclad. Things looked rosy.

However, Rev Can were taking too much of his not-really-hard-earned pile and he decided to move to Bermuda where there is little or no income tax. Good move, right?

Absolutely. His wife LOVED the idea and told him she couldn't wait. So they moved to Bermuda and he bought a motherfucker expensive beachfront mega-mansion. His wife LOVED IT.....

And he loved it too until his wife retained a Bermuda divorce lawyer who sprung the news that pre-nups are illegal in Bermuda and the Bermuda courts refuse to enforce them.

He lost the house and settled up quickly for a lump sum payment of another 15 million $.

Moral of the story: Pre-nup law changes from place to place and a few thousand spent on a good attorney AHEAD OF TIME can save a few million later on.

As far as Tiger, I felt sorry for this guy with all the media hounds on his ass, as I've said before virtually all powerful and/or rich guys fool around, he just happened to get caught, HOWEVER, I just read that he's kept in touch with Uchitel during this so called period of trying to save his marriage, I read they're both in Palm Beach, Florida on his yacht, Privacy. Dumb, stupid, you made a mistake once, but don't keep adding to it, no wonder Elin wants a divorce.

None of us really knows the reality of the marriage, but looking in from the outside, I believe I would have traded my ex-wife's personality for that of Mrs. Woods in half a heart-beat.

Furthermore, if she goes home to Sweden, good luck to Tiger with child visitation rights.

I thought I read somewhere today, that Uchitel was selling her story to one of the big tabloids for 6 million which she will get right away. Her deal with Tiger would only pay out over a period of years. So she was taking the tabloid deal. Oh well, I guess we will have to wait about 20 minutes so the story can change again.

Moral of the story if you are going to cheat and have a pre-nuptial or ante-nuptial agreement make sure you are in a jurisdiction where whether you screwing around isn't taken into consideration.

In most jurisdictions in North America the divorce itself is almost always "irreconcilable differences - no fault" even when fault grounds are recognized.

"I won't apologize for what I am, I got married too young and it was wrong. I am sorry if I hurt Elin, I care a great deal about her although it may not seem to be the case. I will look after her and our children forever, and hope we can someday be close friends again. In the meantime, golf is my life and I will continue to play and try to win. If people are disappointed in me, that isn't my problem. I will no longer try to be something I am not and continue in my quest to be the best golfer I can possibly be."

Alexmst, has a greater insight into Florida than I. But in general Judges really don't like to enforce pre-nuptial agreements when there has been infidelity and they feel that the innocent spouse is "taking a bath" Technically this is part of what is termed unconscionablity and is what I was driving at in #4.


Further, as I've mentioned in the past, given that English is not her first language, unless Tiger’s legal counsel were careful and made sure that she had a competent Swedish speaking lawyer, she can with good counsel likely drive a bus through the pre-nuptial on that point alone.

I have no sympathy for Tiger at all. If it was only once or twice he cheated, then maybe. But if even a fraction of these stories are true, he is dumber than a piece of freakin furniture. Between escorts, not using a condom, etc if these are true he deserves everything he gets. Why get married if he was going to act like that. Why not just stay single and have all that fun. And too compound it with sending texts, leaving messages and all then he really wasn't thinking things out.
