Ok but my question is does ones nationality make a difference? Do Canadians and Americans think alike about this? What about Europeans on TERB? I suppose Danmand can take his pick as to what category he wishes to be in.
I know very little about this case but I do care about extradition law because I feel there is currently an improper one going on between Canada and the US (Marc Emery.) As I understand it extraditions are based primarily on two things (outside of does the case have merit which I will assume it does): is what is being accused a crime in both jurisdictions and are the penalties reasonably similar. If the answer to both these questions is yes then yes he should be extradited.
The sympathy for Polanski is through hypnotism from his films, that were not banned in the USA, by the way. Even Harrison Ford worked with him.

Sadly, it appears we don't.
With 36 votes tallied, there are four identified from foreign (non-Canadian, or dual nationals). 10 Canadians but ZERO foreigners (of an admittedly small sample of four) believe that he should not face justice for the rape (statutory or otherwise) of a 13-year old girl.
It seems that 1 in 3 Canadians (who have answered this poll) believe that you can rape a 13-year-old and then as long as you reside out of the country for 30 years you did nothing wrong. I am appalled.
I'm beginning to see Polanski's point though. The guy is going to say something like: I didn't know she was 13 years old. She was not a virgin (at the age of 13!). I thought I was banging a 16 year old (legal at the time). She is lying when she says she said "no". In fact, I recall her urging me on.
As soon as I was charged, she and her folks sued me for a million bucks.
They stuck my ass in jail and I was scared and having a nervous breakdown. So I had my lawyers cut a deal with the DA that I got out with time served. The DA jumped at this because the girl is such a liar that he knew there was no other way he could have convicted me.
Then the crazy prickish old judge tells me that he is going to give me another FIFTY YEARS in jail when I am sentenced!!!!!!!! (This info comes from CNN).
So I did what any sane person would - jumped bail and flew back home to France. Since then, I have been throwing thousands of $$$ at my lawyers, trying to have them straighten this whole mess out and claer my name.
In the meantime, I had to pay that girl's bitch mother - the same person who arranged for the girl to come and see me that night - $$$$$$$$$ just to get them to leave me alone.
What would you guys have done??

Which I don't think will be very long as many of the guys in prison will have had 13 yr old daughters..... I think he'll find himself on the other side of a non-consensual sex act... but it's OK because he's not a virgin right....

Said it before... and I'll say it again... I have absolutely ZERO tolerance for child molesters... Too bad the rest of our society didn't feel the same.
Not fucked 13 year old number one, not have fucked someone I thought was 16 number 2, done a better job cutting my deal so a judge couldn't fuck it up number 3 not broke more laws running away and gone after that judge while serving my plea deal number 4.
Let me guess, that you probably also would not drive your 13 year old daughter dressed like a 16 year old to spend a late evening with a film instructor known for liking young girls.

In Canada tha is not a defense. I don't know about where he was charged, but in Canada the law is quite clear: The onus is 100% on the adult to verify details like age. Period.
Translation: Polanski was not the first person to sexually abuse her.
Children make bad choices, that's why the law asserts that they cannot legally consent. Moreover they are easily manipulated by adults, for example, an adult could manipulate a child into saying "I told him I was 18", or manipulate an unwilling child into saying "it was my idea".
In fact, adults are so good at manipulating children that the child may even believe it was their idea. Adults mold the ideas that children have and can plant pretty much any idea in a child's mind, especially over time.
As a result of children's inability to make good clear decisions on their own behalf, and as a result of how easy it is for an adult to manipulate a child, the law is quite blindlingly clear in Canada: The onus is 100% on the adult to verify details like age, and ignorance of age is no defense whatsoever to a charge of statutory rape.
The law is written that way for a damn good reason.
Now again I don't know the law in California, maybe there ignorance is a defense--if so they should update their law and bring it into the modern era.

LOS ANGELES, March 12, 1977 — Polish film director Roman Polanski, widower of murdered actress Sharon Tate, was free on bond today on charges of luring a 13-year-old girl to the home of Jack Nicholson under the pretext of photographing her, then drugging and raping her.
Polanski, 43, was arrested by police to Beverly Wilshire Hotel Friday night following the incident Thursday night at Nicholson's Bel Air home.
In addition to the rape charges, Polanski also was booked on suspicion of sodomy, child molestation and furnishing dangerous drugs to a minor. He was released on $2,500 bond pending his arraignment March 18.
Nicholson was reportedly out of town at the time. A spokesman for the district attorney's office told reporters that Polanski recently met the girl's mother and arranged for the girl to pose for some photographs for the French edition of Vogue magazine.
He said Polanski took some pictures at a first photographic session two weeks ago, and among these pictures was one of the girl nude from the waist up.
He said the mother became angry when she saw the picture and questioned her daughter when she returned home from the second photographic session Thursday night. Officers said the girl told her mother that Polanski had given her a tablet of the powerful tranquilizing drug Quaalude.
The director then raped the girl and forced her to commit various sex acts with him, police said.
Polanski made no public comment on his arrest. He surrendered peacefully when he was taken into custody at the hotel.
