What if...it turns out..he was moving away from the shooter...going for someone else in a menacing or deadly way.

If a guy is running towards my daughter or wife...but away from me.....I pull out my shotgun and blow the back of his head off!

Hopefully you don't proceed to blow your wife and daughter's heads off in the process. Shotguns have a tendency to not distinguish between the good and the bad guys when fired in the direction of both.
