Depressing but also interesting situation. France has some of the toughest privacy laws in the E.U., however, French courts for about the past decade been awarding damages of only about 20,000 Euros (Ironically 40 years ago awards were much, much higher) hence a number of not particularly pleasant publishers have decided that loosing in court is an acceptable cost of business.
Such photographs would clearly be considered an invasion of privacy (taken on private property with very long lenses) in the U.K. and Canada a bit more questionable regarding a "public figure" in the U.S.A. but still likely to cost a publisher a great deal of money.

I suspect the whole "photo session" was planned. The royals live for and of publicity, and need this kind of exitement as bad as the Kardashians. This is big business, and they profit handsomely from it. Hence the pictures of Harry and Kate. Next there will be a sex tape leaked to the web.

Also likely to be prosecuted as a criminal offense "fixing, recording or transmitting the image of a person in a private place without their consent" potential imprisonment and a €45,000 fine.
