I'm on the side of the judge got it wrong. And if you were to do a poll, I'd imagine that's the general consensus.

Question, what would the sentence be it they had shoved a broom handle up a female student's ass? Can you imagine the outrage if they walked with nothing more than probation?
If the victim was a female there would have been a substantial amount of jail time.

Judging by how frequently he's on his knees for Ford, he was certainly on the receiving end.

2 years of probation for what they did to that poor kid is a fucking joke. Our justice system is fucked.
I don't know how you make a privileged, private school kid the Minister of Education. If I was the union I would be all over this.

The minister could care less about public-funded education. Stephen Lecce's dad went to St. Mike's too so there's a strong possibility the minister's kids won't be in our publicly-funded schools.

No skin in the game. No wonder he can be such a hard-ass in these negotiations.

It would have been exactly the same. They're juveniles. They get very soft sentences. It's standard.

If they were adults, it would have been totally different.

Let me tell you something about Brian Weagant. He is one of the leading children's rights advocates in the country. His leading case (when he was still a practising attorney) was the Supreme Court case that made physical discipline of children illegal in Canada. Before Weagant took that appeal, it was perfectly legal to beat a kid black and blue with a belt and it happened a fair bit.

You can thank Weagant that the practice was outlawed in this country.

It's not so much the judge got it wrong, it's the Canadian criminal justice system got it wrong.

We don't throw the book at criminals anymore. Violent crime like this case nets you a slap on the wrist, if that.

When the conservatives under Harper proposed changes like changing the sentencing guidelines so that a life sentence actually meant a life sentence, there were howls of outrage in the media and supposedly in the populace (not me). Of course, we don't have enough money to incarcerate all the criminals out there, but that's another issue.

It's not so much the judge got it wrong, it's the Canadian criminal justice system got it wrong.

It is not a justice system. It is a legal system. Criminals have rights and they use them well. Well their lawyers do which is why wealth plays a part in getting less jail time. These guys can afford it. A black man charged on a dime bag doesn’t have enough money to fight it in court. Legal aid does not cover trials. So he has no choice but to plead out. Now he has a record, now he can’t get most good jobs and the cycle of going downhill starts.

I agree change to sentencing, especially for violent crimes is needed but help for the poor in criminal cases is also needed. It would make a world of difference. If it could be done.

Sadly we live in reality and that ain’t happening any time soon.

Most of you know or heard what fraternity initiations are. They always have some rituals and hazing is quite often a center peace of it.

One of the rituals in hockey world is the infamous stick up a bum. If you ask NHL players about it, most will nod their heads without divulging too much information.

This ritual's been happening at St. Mike's for quite a while. Many have gone through initiation. It's a dark secret. This time it was exposed to broad public.

Those kids neither invented the ritual nor were the first ones to perform it. Privilege has very little to do with judge's ruling. There's a real domino effect in play here.

If a teacher was too creepy at one private school, they’d just send them to another in what was referred to as “pass the trash”.
Whenever this stuff happens, it’s because the teachers or coaches weren’t watching when they could have easily prevented it by simply being in the room or near it.
UCC had a huge court case back in 1990s about a teacher who buggered students over the years while the school covered it up.

I’m sure there are plenty of old boys from these schools on this site who could chime in here.

I can see a difference though between a young adult in a frat peer-pressured into be part of hazing and being held down and a broom shoved up your ass. There is also a line between 'harmless' activities like rookies carry the bags and forced drinking.

The fact that this was going on in a school and staff admitted that there regularly was some kind of hazing will leave them open to civil liability (or being one of those elite places, either quite payoffs or influential alumni continuing the pattern to shut them down).

I'll also bet that being a prominent football program, the coaches probably did it when they were players and watched some of the hazing while laughing.
