In Canada it is legal to record a conversation you yourself are a participant in. It is criminal to record a conversation between others, where you are not part of the conversation, without explicitly telling them. That is why whenever you bank records a call between you and one of their tellers they play a message informing you.

Intercepting text messages on somebody else's phone is certainly a criminal offence in Canada, unless you do it with their explicit informed consent.

In Canada it's illegal to pay a woman for sex . Even asking her is a criminal Federal Offence . So what's your point about intercepting text messages being against the law . So what . Big deal. Do we break laws that we don't like or are not convenient for us . Moral of the story is pick and choose which law you wish to follow . That's what everyone else does .
