Speeding ticket advice needed

The prosecutor only has to prove that you were speeding. By how much is virtually irrelevant. If your defence is "I was speeding, but not by that much" save your time and money, 'cause you're going down.

In a situation such as this, you should have asked the cop to show you the radar on the spot that it was showing 30 over.

I do not know for sure but I have been told by cops that they are required to show up for a speeding trial under the Police Act.

You were very very lucky. It really depends on the jurisdiction. As a for instance a year or so ago in York region area the Chief put out a mandate that the coppers would be in court and the region would pay the OT, so a lot of people got caught. All of this was because they needed to use the "oh the copper never showed due to budget" as the "public" reason for the dismissal of charges against a high profile pol from Vaughan. Media knew he got preferential treatment but the spin/cover story was Chief alarmed to find high rate of officers not going to court. To back up this excuse they put on a full court press ( so to speak) for the next little while to compensate. So for the next while all the poor joes without political juice actually had the cops showing up 100%.

its all a game anyway.

I was told last time I got a ticket that they will NOT show the radar gun as they say it is a safety risk.... I know that is bullshit because I was speeding and the prosecutor confirmed that is no defence

Agree with the honorable Perry Mason. These guys have heard it all a dozen times over every week.

The one that made me laugh the most was a guy who was doing 80 in a 50. He got caught, took a wrench, found a speed limit sign of 80, took it off and hung it over the existing sign where he got caught. He took a photo of it, got some witnesses and went to court and won.

This may just be some urban legend.

Eat the cash, call xcoppers and let them plead it down and DON'T EVER SPEED AGAIN!!!!!!!

I have time to go myself, and hope for the best.

I know I am an idiot to (get caught) speeding, I never really speed, just
forgot myself 1:30 in the morning on the empty 403.

I should have posted this like: A friend of mine was caught speeding .....

The general rule of thumb is the cop will be there . The court time is part of the renumeration for the constables. It is when they are on overtime that you can "get off" . In York and Toronto the court time is scheduled and they are required to be there. The municipalities need the revenue from the tickets. Get on of the xcopper type guys to talk to you and take it from there.

While I agree with some of your logic, here you sound a bit silly. You are going to challenge the ticket on the grounds that the radar gun has not been calibrated correctly, but the speedometer on your old pickup is calibrated correctly? When was the last time you had the speedometer on the pickup calibrated. Be sure to bring on the documentation on that. LOL

Well I'm no expert but I played around with the calc. on the site and found out my tires would have to be about 2" bigger in Diameter in order to get a 10% increase on the speedometer.

My question to the tire guys out there... would it be likely that you would buy winter tires that were 2" bigger than your stock tires?

The Houdini gave good advice. I just had an experience with the OPP. First of all they schedule your court date around the cop's availability. You will arrive in court and find the cop present, and every other case on the docket to be his tickets. In my case the cop actually lied on the stand, but since he is an officer of the law the judge believed him because "he had no reason to lie". Well, he lied because he knew he could and there was no way to challenge him. You don't have a chance fighting it. But every case that came before the court and plead guilty, was plead down - it didn't matter whether thay had a lawyer, someone from XCopper, or represented themselves. They all got the same deal. Just go to court yourself, you will be invited by the crown prosecutor to plead your case down before the court starts, and that's as good as you are going to do.

Don't be hard on yourself, we all do it. First time i picked up my new vehicle and drove down the 401 at night i looked down at my gauges to see i was doing 140.

Holy shit! The ride was so smooth over my old pickup that it seemed like 100K.

I feel for you man because i have been in your shoes.
