While spy cams and upskirt filming may not be CRIMINALLY illegal, they do give rise to CIVIL lawsuits for "Invasion of Privacy".

The most famous example of this type of lawsuit is the Chuck Berry case. Yes, the Rock n' Roll Hall of Famer is - or at least was - a bit of a perv. His "interest" lay in spying on attractive young ladies urinating. And conveniently, Chuck had his own club in St Louis. So he arranged to have spycams installed in all the ladies' loos. Unfortunately for Chuck, an idea like this doesn't stay secret. The story was "leaked", so to speak. And this led to a class action lawsuit brought by a large number of female patrons of Chuck's establishment. Reportedly, Chuck settled out of court for a cool mill!

There have been cases closer to home. I recall reading in the law reports a few years ago about a local peeper who installed a spy cam in a cabana out by his swimming pool and filmed various guests and - I believe - a babysitter while they were changing. The lens was spotted and the filmlover was outed and sued. Again, the damages award was pretty hefty.

Just goes to show: Peeping leads to Weeping!

the response to this thread is interesting, 9-10 of us believe it to be on the wrong side of society.

i have a cam on my PC, and yes i have thought of filming many ladies since i bought it........ and sure the thought of hiding it did cross my mind...... and most men's minds i am sure. but the difference is this....

i thought about it, i never did it!!!!

we all grow up, listening to our parents... them telling us right and wrong. after awhile common sense kicks in, and we just know what right and wrong are.

personally, i think filming some1 without their knowledge is wrong

No, the cabana case was in Toronto, i believe and damages were reasonably generous. Not California generous, but hefty none the less. A plaintiff bears the burden of proving his case and in a civil suit, that's on a "balance of probability" basis. If the judge thinks it's more likely the stuff happened than it didn't happen, the plaintiff wins.

(The criminal standard is far higher: "beyond a reasonable doubt".)

If you win your case, the other guy pays your lawyer costs. It's what's known as an "incentive" to settle quickly if you're clearly nailed.

Re the toe-cam cases, I'd be interested to learn the outcome of those. I believe the alleged malfeasor was charged with "disturbing the public peace", a fuzzy catch-all charge. However, I don't know if he was convicted. The very fuzziness of the charge would lead some judges to say it was an unconstitutional prosecution. (The criminal law should be clearly defined - well, to lawyers and judges anyway!) When I saw the new Code amendments, I sorta guessed maybe he'd been acquitted on those technical grounds.

With no consequences to their actions these disrespectful guys will continue this behaviour and try it again with someone else.

Since they have no respect for a SPs personal privacy than their personal info needs to be passed onto EVERY Sp and escort agency and they should be blacklisted. Just like what would be done if it were discovered that an incall SP was privately videotaping her clients.

As if our job is not stressful enough..........
We have to walk into a EACH call not knowing if the guy is....... hiding his four buddies in the closet to rape and beat us,
or if he is a psycho crazy strangler/murder,
if it is a cop waiting to arrest us,
and now........... if he is videotaping us without our permission.

Who says this is easy money?

I DON'T think the answer to this sort of thing is having some goon "bodyguard" beat someone up.

While secret attempts to film SP's are antisocial, they do not merit people getting hurt.

Very true oagre...

one wrong does not justify another...Judges and juries do not look upon acts of violence very well, unless it is in self defense.

Legal or illegal, right or wrong...... *some* people dont care about laws.

All I saying is if a guy wants to take a chance to violate a woman by privately videotaping her....... than he is opening himself up to many possible negative 'consequences' for his behaviour.

Just as he was wrong and assumed she would never be smart enough to detect him videotaping her........he also may be VERY WRONG in assuming her reaction to the discovery will be level headed, and non aggressive!

Some women may take the tape and walk away........but some women may not!
These guys dont know who they are possibly messing with or the 'connections' some ladies may have.

And dont forget that some people are not afraid of the police or being arrested, yes some people are that 'rough' and crazy... and they might already have a criminal record and another one is no big deal to them.

She has his real name and address and knows what he looks like. Who knows she may send someone after him months down the line and how can he prove it or even know it was her. He may have to look over his shoulder for a long time, everytime he leaves and comes home.

Do I think most escorts would do this? No. But he may pick that 'one' vindictive, crazy one, and regret his actions for the rest of his life!!!!!!!!!

But I guess thats the chance that some men are willing to take.

Well, she'd have to be pretty crazy, wouldn't she? Videotaping someone covertly is a lot less serious "bad" behaviour than beating someone up or arranging a beating. Let's have a sense of proportion here. The charge for upskirt videotaping is about as minor as you can get in the criminal code and the punishment is likely going to be a stretch of probation wherein the miscreant is barred from the premises in question for a year and made to take counselling.

People who beat other people up get sent to jail for 3 or 4 years. That's a pretty good measure of how the 2 acts stack up against each other.

I mean, I get pissed off when some a-hole cuts me off in traffic and doing that's against the law as well. However, I don't take a billiard cue and smash his head in.

Sure you may not, but as a lawyer, you cant be that naive...... you should know that some people are that crazy and are not thinking about what laws they are breaking and the punishment they may receive in the moment. STRANGER things have happened! ( Someone once told me there was an escort who provided incalls and would threaten and beat up clients with a baseball bat and then rob them if they tried to leave without paying her if they did not find her attractive. She finally got arrested but did not care and spent a very short time- a month in jail) Look how packed our criminal courts are and our jails, obviously there are MANY people who when in rage do not think or CARE about the consequences of their actions, and act unreasonably, illegally. And the 'smart' criminals cover up thier actions very well to avoid arrest and prosecution. Who knows she might be crazy enough to get someone else to smash the guys car or house many months down the line or have someone wait and hide to beat him up. And if someone does not have enough evidence to prove it beyond a reasonable doubt they are out of luck. Saying I think it was escort A because I privately videotaped her 5 months ago will not hold up in court.

I recently saw a road rage fight, in broad daylight at Parliment and Bloor, one guy opened his trunk to get his tire iron, to fight a guy, because he cut him off. Do you think in the moment these guys were thinking about laws/jail sentences. Obviously not, because they did not even care about risking their own life/safety. Sure they may regret their actions later, but after one guy practically got his eye knocked out by a tire iron...how is a criminal record/jail sentence going to fix his sight. If it was the States he would have probably got his gun, like we have seen in the news on many occassions.

You never know what you may trigger in someone, some people maybe hiding how crazy and deranged they really are.

I finally got around to reading this thread and have a couple of comments:

1) videotaping in your home: While you have a reasonable expectation that the tape you made will remain secure and private that is at this point in time. I have made videos of ex gf's (with their permission) and at the time they were destroyed as per her request. Hindsight being what it is, this was a good thing. When she dumped me I was so hurt and upset that had I had the video, I probably would have submitted it to an online site. (this alludes to the emotional state of someone and how illogical they can act under certain conditions).

2) Revenge for the video if discovered: While a good beating may be illegal and the jail time for upskirt vids is a lot like a slap on the wrist, this is just another example of how society looks upon the violating of a woman's rights as a bit of a joke. This is not just an invasion of privacy but akin to sexual battery or assault. This is similar to the cases where a woman gets drunk, goes home with a guy, says no at the last minute but the guy has sex with her. Finally the laws have termed this date rape and there are charges laid. I say make the punishment fit the crime (in all offences) I'd say get the big boys to tape him to a chair nude and then video tape thowing all sorts of condiments (no, not CONDOM MINTS, aka ketchup, mustard, mayo) etc. The clincher would be leave him that way until the maid shows up! If you let them get away without even a slap on the wrist what's to stop him from trying again?

3) anything can be a cameras these days: Don't make out in front of VCR's, teddy bears with big noses, those two are sold on the net. There are all kinds available at spy shops. I'd be a little leary if some guy is trying to position the sp so her butt points to that large box of chocolates on the dresser ! (sorry, I couldn't resist that one! lol)

4) M & D teaching right and wrong: You know, this is a pretty messed up world we live in and it is obvious we can't count on parents to teach their kids the difference. Look at what's happening in the school system with gangs beatings, swarmings? Maybe its time soceity took it upon themselves to start teaching ppl the difference! I'm not into putting him in the hospital for attempting this but I tell you, a broken hand will remind him every time he tries to whack off to one of his vids!

5) Guys who NEED to keep a record of their exploits are pretty insecure. I mean, isn't it enough that you have the memories? Do you need to be reminded what a stud you are? And if you think we believe for a second you've never shown any pictures, or the vids to your friends you're dumber than you sound! BTW I remember in vivid detail every encounter I've had (good and bad unfortunately) and I can replay them anytime I want without need of any electronics. I saw this once on the tv show friends: Ross said "as is my right as an ex boyfriend I can see you naked anytime I want" "whoops, there you are again, whoops and there you are again, holy cow, there's a whole line up of naked Rachels" LOL

My advice is: commit the act to memory you dork(s) and leave the filming to the pros!

in the states it's not illegal to video/photograph someone unknowingly, only record their voice, stupid wiretapping laws, but here voyeurism's totally illegal, but nobody would really do anything about it, unless like 99% of this stuff, gets passed around to all the guys buddies and eventually finds it's way to the girls parents
