For what it is worth, it isn’t illegal for a lady to advertise as an escort, or be an escort. She is charging for time and companionship.
It is illegal to offer sex for money (solicitation) or to have sex for money (prostitution) in the U.S.
Most escorts screen in the U.S., so they never talk to a cop about services or end up in a room with a cop. Many won’t discuss sexual services at all online or over the phone/text, just in case.
Of course, many straggle the line. Some ladies have on their website activities they enjoy in private such as BBBJ / CIM. Some of them direct the potential customer to read their reviews to find out about specific services, and some do a direct link to those reviews.
Reviews are of course anonymous and generally labeled as fictional writing on websites. The great unknown legal question is whether the escort turns it into nonfiction by mentioning it, or linking to it. The same legal question exists if listing activities she enjoys in private implies that she will do them with a customer as a result of receiving money.
The more established an escort is, the less likely she is to have explicit information on her website to test those questions.
For what it is worth, U.S. law enforcement has traditionally turned a blind eye to escorts who screen. There are plenty of mass classified advertising sites where “lower-end” ladies go so far over the line that you can’t even find the line. And those are the same websites that law enforcement takes out fake ads to arrest Johns when they respond and start mentioning sex for money in their discussions with the police (who certainly don’t screen). That is where the U.S. arrests take place by state and local law enforcement. Federal law enforcement goes after anything organized such as agencies that cross state lines in their operation, but federal law enforcement activities generally do not pursue either Johns or sex workers. Independent escorts, agencies that don’t cross state lines, and very small operations do not get the attention of federal law enforcement in the U.S.
There is an obligation when straddling a legal line not to wave your arms, show off the goods, and say Look at Me. So she did the thousands of U.S. independent escorts who avoid mass classified advertising no favors by appearing in the media.
