Passing meeting vehicles


148. (1) Every person in charge of a vehicle on a highway meeting another vehicle shall turn out to the right from the centre of the roadway, allowing the other vehicle one-half of the roadway free. R.S.O. 1990, c. H.8, s. 148 (1).

Vehicles or equestrians overtaken

(2) Every person in charge of a vehicle or on horseback on a highway who is overtaken by a vehicle or equestrian travelling at a greater speed shall turn out to the right and allow the overtaking vehicle or equestrian to pass. R.S.O. 1990, c. H.8, s. 148 (2).

Exception

(3) Subsections (1) and (2) do not apply to a person in charge of a road service vehicle or a road-building machine or apparatus while the machine or apparatus is engaged in the construction of a highway. R.S.O. 1990, c. H.8, s. 148 (3).

Vehicles meeting bicycles

(4) Every person in charge of a vehicle on a highway meeting a person travelling on a bicycle shall allow the cyclist sufficient room on the roadway to pass. R.S.O. 1990, c. H.8, s. 148 (4).

Vehicles or equestrians overtaking others

(5) Every person in charge of a vehicle or on horseback on a highway who is overtaking another vehicle or equestrian shall turn out to the left so far as may be necessary to avoid a collision with the vehicle or equestrian overtaken, and the person overtaken is not required to leave more than one-half of the roadway free. R.S.O. 1990, c. H.8, s. 148 (5).

Bicycles overtaken

(6) Every person on a bicycle or motor assisted bicycle who is overtaken by a vehicle or equestrian travelling at a greater speed shall turn out to the right and allow the vehicle or equestrian to pass and the vehicle or equestrian overtaking shall turn out to the left so far as may be necessary to avoid a collision. R.S.O. 1990, c. H.8, s. 148 (6).

Driver unable to turn out is to stop

(7) Where one vehicle is met or overtaken by another, if by reason of the weight of the load on either of the vehicles so meeting or on the vehicle so overtaken the driver finds it impracticable to turn out, he or she shall immediately stop, and, if necessary for the safety of the other vehicle and if required so to do, he or she shall assist the person in charge thereof to pass without damage. R.S.O. 1990, c. H.8, s. 148 (7).

Passing vehicle going in same direction

(8) No person in charge of a vehicle shall pass or attempt to pass another vehicle going in the same direction on a highway unless the roadway,

(a) in front of and to the left of the vehicle to be passed is safely free from approaching traffic; and

(b) to the left of the vehicle passing or attempting to pass is safely free from overtaking traffic. R.S.O. 1990, c. H.8, s. 148 (8).

Driving to left of centre prohibited under certain conditions

149. (1) No vehicle shall be driven or operated to the left of the centre of a roadway designed for one or more lines of traffic in each direction,

(a) when approaching the crest of a grade or upon a curve in the roadway or within 30 metres of a bridge, viaduct or tunnel where the driver’s view is obstructed within that distance so as to create a potential hazard in the event another vehicle might approach from the opposite direction; or

(b) when approaching within 30 metres of a level railway crossing. R.S.O. 1990, c. H.8, s. 149 (1).

Exception

(2) Subsection (1) does not apply,

(a) on a highway divided into clearly marked lanes where there are more such lanes for traffic in one direction than in the other direction;

(b) to a road service vehicle where precautions are taken to eliminate the hazard; or

(c) on a highway while it is designated for the use of one-way traffic. R.S.O. 1990, c. H.8, s. 149 (2).

Passing to right of vehicle

150. (1) The driver of a motor vehicle may overtake and pass to the right of another vehicle only where the movement can be made in safety and,

(a) the vehicle overtaken is making or about to make a left turn or its driver has signalled his or her intention to make a left turn;

(b) is made on a highway with unobstructed pavement of sufficient width for two or more lines of vehicles in each direction; or

(c) is made on a highway designated for the use of one-way traffic only. R.S.O. 1990, c. H.8, s. 150 (1).

Driving off roadway prohibited

(2) No driver of a motor vehicle shall overtake and pass another vehicle by driving off the roadway. R.S.O. 1990, c. H.8, s. 150 (2).

Non-application of subs. (2)

(3) Subsection (2) does not apply to the driver of,

(a) a motor vehicle overtaking and passing to the right of another vehicle where the shoulder to the right of the roadway is paved and the vehicle overtaken is making or about to make a left turn or its driver has signalled his or her intention to make a left turn;

(b) an ambulance or fire department vehicle as defined in section 61;

(c) a police department or Ministry emergency vehicle;

(d) a tow truck where the driver is responding to a police request for assistance; or

(e) a road service vehicle. R.S.O. 1990, c. H.8, s. 150 (3).

Note: On a day to be named by proclamation of the Lieutenant Governor, subsection (3) is amended by the Statutes of Ontario, 1994, chapter 27, subsection 138 (14) by striking out “or” at the end of clause (d), by adding “or” at the end of clause (e) and by adding the following clause:

(f) a motor vehicle overtaking and passing to the right of a road service vehicle or road-building machine where a person apparently employed by or on behalf of the authority that is engaged in the highway maintenance operation has directed the driver to pass it and the movement can be made in safety.

I agree with many of the above, like driving in the passing lane and driving slow in general and not signalling and left turn retards and so on....but I'll add another I haven't seen yet.

I hate the morons who go to make a turn (say to the right) but right before they do, they edge to the left into your lane to do so. If you cannot make a turn from the designated lane, you shouldn't be driving.

We so desperately need regular retesting of drivers in this province.

Passing Lanes

North of Parry Sound, Highway 69 is two lanes with passing lanes every 7 to 10KMs. It drives me crazy when you get to one and the person you have been sitting behind (not tailgating) speeds up when they get to the passing lane and then slow down again when it comes to an end or refuses to pull over to the left! What results is a long "konga line" of pissed off people now willing to take greater risks to get past the asshole at the front:mad: !

What pisses me off is people who think they have the right to get where they are going faster than I am when on the QEW parking lot. They are the ones who stay in the right lane, then go into the exit lane, only to dart back in to traffic before they get off the highway. Then they do the same on the merging lane after the exit. I have seen more than a few close calls from yaholes who decide to do this idiotic move.

Makes me wish I had a cherry to put on top of my vehicle!

Drivers who exceed the speed limit (emergency vehicles with their lights on excepted)

Drivers attempting to pass me, or getting upset that I'm in the left lane when I am already doing the speed limit.

Agressive and impatient drivers.

when some one pulls out in front of me when im doing 10 over the speed limit and proceeds to drive 10 under the speed limit while talking on their cell phones.

i hate when people run red lights while making a left hand turn then screw up the very short advance green.

people who drive way under the speed limit when the driving conditions are perfect

when guys beep at me when im driving or try to get my attention by yelling "yo" out the window.

YES! Especially the cell phone thing where it's banned in some states in the USA and it should be here!

I couldn't believe it one time at Timmy's, this lady was having a hard time reversing into a parking spot...but she wouldn't put the phone down for one sec. to make it easier.

Should have been okay to pass the truck (assuming you were on a multi-lane highway of course <grin>) according to 150 (1) (b):

150. (1) The driver of a motor vehicle may overtake and pass to the right of another vehicle only where the movement can be made in safety and,

(a) the vehicle overtaken is making or about to make a left turn or its driver has signalled his or her intention to make a left turn;

(b) is made on a highway with unobstructed pavement of sufficient width for two or more lines of vehicles in each direction; or

(c) is made on a highway designated for the use of one-way traffic only. R.S.O. 1990, c. H.8, s. 150 (1).

Just because you are doing the speed limit, doesn't mean you can legally ride in the left lane.

147. (1) Any vehicle travelling upon a roadway at less than the normal speed of traffic at that time and place shall, where practicable, be driven in the right-hand lane then available for traffic or as close as practicable to the right hand curb or edge of the roadway. R.S.O. 1990, c. H.8, s. 147 (1).

So even though you are doing the speed limit, if the majority of traffic around you is doing 110 you should not be in the left lane. The fact that they are technically speeding is irrelevant since the cops don't usually ticket unless you are much higher than 10 kph over.

When some one does somthing really stupid I usually see them with a cellphone or reading a map .I also do not like it when you need to make a left turn and the last few cars go threw the yellow or even the red light screwing you chance to go . and Every light should have a left turn light ,some don't

Actually, your ultimate and best legal defense for when passing on the right is to state that you were no longer passing due to the truck in your way and therefore returned to the right lane as the law requires. The fact that you were then driving faster than the truck is irrelevant as he is obligated to b in the right lane if he is not passing.
