I've been to Mildred's Temple Kitchen a few times. Good Restaurant, good Brunch on Sundays too.

Just because the Board of Health allows it, does not mean that you could not get arrested for it. Fucking in a restaurant would be considered an indecent act, only private clubs are allowed to have open fucking. Lots of people have sex in washrooms of bars, I have a friend who is really into it, certainly not my thing.
Last summer I walked into a young couple doing it in a Macdonalds bathroom downtown. They were just finishing their act when I walked in and they escaped through a fire exit at the back of the restaurant.
Yes, when I said fucking in a restaurant I meant out in the open in the restaurant. I believe an earlier poster had mentioned that? I think you are right, that if it was a room with a lock, it would not be public. But a stall that a tall person could peer over? I am not sure whether that would count as private. But it seems pretty common in bars, without serious consequences.
Yeah if the restaurant was encouraging you to have sex in a stall or in the open it could get dicey. The news article in post #1 features a photograph of one of their washrooms and it's clearly a rather large spacious room with its own door and romantic fixtures such as candles. In the photo the woman is locking the door behind her.
