Here are some thoughts…
-how can the players say they were too drunk to remember but insist she wasn’t?
-if she had regrets when she sobered up tells me she was drunk when the activity went on, you don’t sober up from being sober

I wouldn’t be surprised at a mixed verdict…some convictions and some acquittals.

So you quote what a lawyer says about the defense position…the crown will have a different position and are going to take an entire day to express it.

A person cannot say they mistakenly believed a person was consenting if:

  • that belief is based on their own intoxication; or
  • they were reckless about whether the person was consenting or;
  • they chose to ignore things that would tell them there was a lack of consent; or
  • they didn’t take proper steps to check if there was consent.

Doing the right thing was definitely not in play.

-E.M could have made better decisions
-the 5 accused could have made better decisions
-a couple players not charged, mainly Howden, could have made better decisions
-The London Police in the first investigation could have made better decisions
-Formenton’s attorney causing the mistrial and jury discharge could have made better decisions
-Formenton’s attorney causing the discharge of the 2nd jury could have made better decisions
