So here's what happened to me yesterday...
I was driving along the 407 at a decent speed when I realized there was an OPP car up ahead of me driving in the right-hand lane. I was already in the middle lane with a few cars behind me. The car to my left immediately slowed down and got in behind me.
Keeping a constant speed as to not pass the cruiser at about 119. The cruiser started slowing down until I almost had caught up with him - so I adjusted my speed accordingly.
He slowed again as did I - now cruising at about 112. I was close behind him on the highway. Suddenly he slowed quite quickly - I slowed to 109 but did not take it any further b/c I didn't want to make it obvious that I was trying not to pass him.
So I kept driving and gradually passed him going 109 (I was keeping a close eye on the speedometer). As soon as my car makes a full pass - He jumps behind me and puts on the lights.
I've been driving regularly on the 407 for four years - I can't count how many times I've passed a speed trap or diven behind a cruiser at 120 with no problem. Even a traffic cop friend of my family assured me that as long as i did not exceed 119 - the police won't pull you over for speeding.
I couldn't believe I was being pulled over for going 109 on the 407 where average speed is 120 and average speed in the passing lane is `135 - 140.
So the officer walks up to my car - he's young. Huffs out "going pretty fast there eh?"
I bit my tongue. But when he told me I had passed him at 120 I had to speak up.
So I told him I had my car on cruise at 109 and I pointed out that I noticed he had slowed down quickly prior to pulling me over.
His reply "what is your speedometer broken?". (on my four-month old car??) After a few minutes sitting in his car - he ended up walking back and giving me "it's your lucky day" and let me go.
My question is - if there's no radar reading - and you are ticketed going at a faster speed than what you know you were going - could one actually lose in traffic court?
