Any two bit lawyer can get him off that charge. I am surprised they did not charge him for leaving the scene of an accident.

My guess is that there are lots of cameras on the 401. They could perhaps get the type of car, or track the route for a bit, or even get a partial license plate. Of course, body shops are also canvased/asked (maybe even required) by police to report front-end damage that corresponds to the accident. Finally, maybe someone close to the putz, or even a passenger, turned him in.

My opinion is if the guy stopped and performed his civic duty, things would be much easier for him.
Um, it was a motorcycle, and the passenger can't turn him in. Oh, and there was no damage to the vehicle.

The passenger is not blameless in her own demise here. Clearly she was not holding on properly to the bike. You really cannot blame the driver completely here. It was his responsibility to ride the bike. It's similar to a car passenger dying when they don't wear a seatbelt. It is also pretty hard to prove the driver evaded police... he may not have seen them bla bla.. I think leaving the scene is really the most likely charge to stick.. ...even then he can say he was unable to stop safely.. so he exited the highway and circled back at which point traffic has been stopped. ... so many outs here. Horrible accident, but to blame the guy 100% is pretty silly. I would not say he is blameless either though.

Why is it wrong to blame the victim. Many people get killed through their own mistakes. Sometimes (though not in this case). The percentage of blame can only be assessed through a full review of the facts. I would say even the cops are about 10% to blame for stopping a bike of the expressway (dangerous in any circumstances) they should have followed him and flipped on the lights after he exited.
