The Florida mom who sued Match.com for $1.5 billion is firing back after the dating website called her lawsuit "meritless" and insisted it was adept at finding fake profiles posted by scammers.
The lawyer for Yuliana Avalos, 31, a part-time model and mom-of-two, released eight sham-dating profiles that he says he found on Match.com and sister sites.
Four of them use photos of Avalos and four others feature famous actors whose faces are well-known to most of the world.
Among the purloined pictures are "Scarface" star Al Pacino, "St. Elmo's Fire" hunk Rob Lowe, tabloid-favorite Lindsay Lohan and Mrs. Justin Timberlake, aka Jessica Biel.

The copyright in a photograph belongs to the photographer (or their employer), not to the model. You are at liberty to sell/assign the copyright in the pic to the model, or to anyone else, if you can negotiate an acceptable price.

If you snap a pic of Elvis walking down yonge street, you own that pic -- to do with, as you please (not fraudulent).

There is no restriction on photographing anyone in a public place. If the public can see it, you can take a picture of it. (A photograph taken in violation of someone's reasonable expectation of privacy is illegal.)

You can be dinged (for libel) if you doctor the photo so it misrepresents what the photo shows the model doing.

So, if the site has doctored her pics, perhaps they can be dinged. But if they are just using her image, her lawsuit is indeed meritless.

C-M you are right it looks less than savory.

Buttercup without looking into this in detail, it would seem as though it would be Misappropriation at least on the part of the scammers if not Match.com
