Good point. If the court refers to Arberry as a victim that would seem to indicate pre-conceived rejection of one of the defences being advanced - namely that Arberry initiated the physical altercation and caused the gun to be discharged.

Dutch, calling AA the "victim" doesn't imply that. It's standard court terminology, like calling the defendants the "accused" or the State the "prosecution".

I mean, he IS the victim. They killed him. The issue is whether they can justify the killing at law.

Yes, clearly Arbery was out running just looking for armed yahoos in pickup trucks to attack and when he found one he went straight for the gun, making them fire it at him.
