Worth noting that it doesn't sound like the guy has forced himself on her, and just saying "this is your job as a wife", while insensitive, isn't rape, so long as that statement is only backed up by threats of separation and divorce rather than anything physical.

But yeah if he used force or the threat of force it is sexual assault.

No, it's not me.
I have absolutely no doubt it's rape in our Canadian society, but in this case, another culture comes into play, even though they live in Canada.

I've suggested that she get a divorce, but her cultural beliefs are strong and she can't bring herself to do that.
Then I suggested she press charges if he continues to force himself on her. This is why I was looking for opinions from those who may know if that's the right course of action.
I've told since they're here, our laws apply fully.

The above two posts are interrelated so one reply.

I bow to the superior knowledge of one of my learned friends of the Upper Canada Bar as to the specifics of the Criminal Code, however, as a general statement both of these indeed involve lack of consent. However, how likely is it that the prosecution will be able to secure a conviction in this type of "he said, she said" and without any evidence of physical abuse or very strong collaborating evidence such as they were in the midst of a divorce to bring charges?

On the other side of the coin, not that anyone here on TERB would get themselves into such a mess. Do you really want to take the chance of being criminally charged with the costs both monetary and social associated with that, and of course the possibility that the Jury believes her version of events.

I did not advocate rape in my post. I never thought a husband
trying to have sex that way constitutes rape.
Lack of consent.

If you are forcing her.. then it is rape
if she does it willingly as a "chore", then I don't see any issue.

Anyway, I would divorce, or if enter some kind of "sexless marriage agreement" in which I have the right to get sex outside
