I had no idea this could happen. Obviously I am no lawyer and while I'm currently defending myself on some false charges, some things really surprised me. Here are the questions: can a private practice criminal lawyer suddenly become a crown? can that lawyer be both? at the same time? private and crown

Also can a private practice lawyer who was previously held in contempt of court [didn't show up 4 times for court dates for her client] become a crown?

Can this same lawyer who previously and very recently defended my relative now be sitting in the same court room as the one I am defending myself in? and possibly working against me with the crown who is prosecuting me?

In answer to your question I have no idea but it sounds like you may be in deeper waters than your floaties permit.

Have you never heard the old adage "he who defends himself has a fool for a client"?

Once that sinks in go buy a real lawyer for at least an hour and take your list of questions to him / her.

Just in general not being a member of the Upper Canada Bar.

Assistant Crown Attorney’s are Civil Servants (lawyers) employed by the Crown Attorney's Office (The Criminal Law Division of the Ontario Ministry of the Attorney General). I don’t know about in practice but certainly in theory one could leave private practice and become an Assistant Crown Attorney or Crown Attorney. More typically though it goes the other way round.

What do you mean by held in contempt? Did the Judge actually impose a sanction? If so what?

you are getting good advice..............when criminal charges are involved you need a criminal lawyer.

If you want legal answers you should consult a member of the Bar of Upper Canada specializing in whatever type criminal case you are involved in.

Yes I understand that as well but what puzzles me is that the lawyer IS in private practice at THIS current time, and is a crown as well "for a couple of weeks" <as per that lawyer. I didn't think that was legally possible.

In the previous case of my relative that lawyer [now crown] didn't show up for 4 consecutive times to the scheduled court dates, had a Judges order to appear and ignored that too, was fined $1500 and held in contempt of court.

At that point that lawyer was dropped and we found a new lawyer, but now that lawyer is a crown that is working with the same crown who is prosecuting me.

Papa, you used too many words in the last posting. Once you decribed the person she needs to consult with as a criminal you didn't need to highlight that they need be lawyers. that goes without saying.




Carefully adopts the protect stance as he fears that DQ will be after him now.

Nothing worse that having a lawyers briefs thrown at you.

You can apply logic and answer your question. If the Attorney General of Ontario (or their designee) doesn't have a problem with it, and, the Judge doesn't have a problem with it, then it is a reasonable presumption on its face that it's allowed.

More importantly I don't know what charges you're facing but it strikes me that you should give serious thought to retaining Counci!

To answer your question: Yes lawyers in private practice on occasion do represent the crown. This happens quite often in smaller communities.

I'd be worried if I had to hire a lawyer that was still practicing. I'd want one that knew how to do it .:D
