Gag orders are supposed to protect defendants--not the government. If anyone in America must have the constitutional right to speak out about the judge, prosecutors, staffs, witnesses, biases, and process, it is a criminal defendant. Especially when that criminal defendant believes the process has been politicized and weaponized against him. Especially the leading presidential candidate in the heat of the election season. If a defendant obstructs justice by threatening witnesses or the jurors, charge him. But you don't put an illegal, vague, and over-broad prior restraint on his First Amendment rights. A sword of Damocles over his head. Then threaten to jail him, based upon subjective standards. Trump didn’t dox the names or home addresses of jurors. Like Democrats did to Supreme Court justices and their families. Leading to the illegal obstruction-of-justice campaigns outside of their homes. Leading to justices and their families going to safe houses. Even after the 1 am assassination attempt against Justice Kavanaugh, Ashley, and their two teenager daughters.
