So is it cheating? Here is the age old debate of what cheating is. Is it emotional, physical, intent?

So guy and girl are dating. Let’s say 8months. He tries to have sex with another girl at a party but because he was drinking, his dick was not working.

is he a cheater?

Now same question but the couple are married 5 years.

Is he a cheater?

Same thing can be said for a women I guess, she was at a party and the guy she wanted couldn’t perform due to drinking?

Agree with everyone here - cheating is cheating if done behind someone's back where its not known for the SO. If you know - then it's not cheating. To practice fraud or trickery. If there is nor fraud or trickery - then you are good to go.

The first scenario is not technically cheating especially if they both didn't really commit, but just dating for 8 months. Perhaps, they are just assessing their options at this point and the guy is testing it out @ the party

The second scenario is definitely cheating on both sides. But, marriage means nothing for some couples anyway. People stay married for many reasons, thus these things deemed to happen at some point whether its 5 years or 35 years.

From a legal perspective that would be similar to an inchoate offense or crime, where there is an intent to commit the criminal act, but the act failed or could not be consummated for whatever reason. Attempted murder is one example.

Very true regarding understanding in the relationship. Now to complicate the issue, let's say from one married couple, who have an open marriage, the guy is at a party and gets it on with the wife of another married couple, who do not have an open marriage.

In this case, I guess the guy would not be 'cheating', but the woman he was with would in fact be 'cheating'. And it can get even more complicated !

But in the end, as you said, what is accepted between two people in a relationship is what matters, at least to them.

What if a couple is arguing and she says "go fuck yourself", then he goes and hires someone to help him fuck himself... is that cheating?

Both scenerios would be considered cheating in my books if your not in an open relationship with the SO meaning she probably didnt know about it. But as a caveat- it would probably be a lot easier to move past with the SO since you never technically did the deed even if the intent was there.
