The 80% thrown out thing was more a misrepresentation than anything else.
The Habba one is also from what I can tell. They presumably had the chance to request a jury trial but it wouldn't have been likely to get and simply made no effort to do it. (Although if they did request it, there is a box to check, from what I gather.)
There is no clear explanation.
No lawyer - even a bad one - would forget to check a box to ask for something as strategically fundamental as a jury trial. The form has been displayed with a box checked off asking for a NON JURY TRIAL specifically. But this appears to be a trial scheduling report filed by the State's lawyers.
So either a jury isn't available on this type of case. Or Trump didn't care one way or the other and his lawyers said "Non jury's quicker and cheaper" and he said "Whatever. Go for no jury."
Or it was always planned as a stunt - That he would deliberately choose non jury and then complain that he was cheated of a jury outside the courtroom, so the Base would feel anger and outrage.
You would need a NY state expert in contractual litigation procedure to explain this one. I'm sure there are 1,000 people sitting in Wall Street mega law factory civ lit departments who are making insider jokes about the issue. But no one else is able to figure it out.
