The lawyers who send 'cease and desist' e-mails to ISPs re: download of copyrighted material from torrents only check public torrent sites, and they base the claim on the download of torrent files, not the upload/ download of the file itself. They don't have access to data recorded by a bit torrent client.
I know this because I once got one of those e-mails about a file I didn't download, but I did download the .torrent file from a public tracker, before finding a better quality rip somewhere else.
I never get those notices from anything I download from thepiratebay, likely because their torrent files are opened in the bit torrent client, but not saved as .torrent files to disk.
I have NEVER received a 'cease and desist' e-mail about any file downloaded from a private torrent site, and I have been a member of many over the past fifteen years or so.
