It is not illegal to ask. The prospective employee can decline.

The physical may also be required if the prospective employee wants to be covered by the company's medical plan. Again the applicant can decline.

If you have any more questions, go ask an employment lawyer. They know more than I. This is a tricky area of employment law. I am not an employment lawyer, I just play one on TV.

I had to run earlier but allow me to expand a bit on my earlier post.

We assess a candidate's qualification in the following 4 categories:

1) Academic --- hard skills is the primary qualification for some of our jobs.
2) Soft skills --- interpersonal, communication, charm, etc.
3) Character --- we ask for police reference report, credit report, integrity,
4) Health --- physical, mental and psych tests

We want to know what and who we are getting.

OK, sure.
And you ware going to find lots and lots of people who qualify based on that.
You are also going to have to do things like decide between three people who are all qualified, but one is better in 1, the other better in 2, and the third better in 3.
(Let's limit it to three, obviously you can have a lot more.)
