Hoooooly shit. This is what happens when asshole meets asshole at the border. The original border guard acted out of line in the first place, but only an idiot messes with a asshole with that much power over them just to prove a point. He had his chances in his secondary interview and he blew them. He deserves to be thrown in prison to cool his heels.

Also it seems like whoever joined them in the 2nd interview was a little quick to say "threat" and "assault".

Pretty sure the guy's not a terrorist though.
 
Yes, they can be on a power trip and are often rude or inappropriate. If I had to do that job all day, I think I might try having some fun as well. Not to be on a power trip. But it must be boring to ask the same questions all day. I might try to spice things up a bit. These guys are the first line of defense. Answer their questions, say as little as possible and comply with their demands. Why? Because they are border guards. They can deny you entry or detain you if they have cause. If you don't like it, stay home.

I'm not a lawyer but the moment when you touch someone when they don't want you too and especially in this situation, they can charge you with assault.
The guy wasn't touching someone, he was trying to avoid being grabbed by dodging away. As far as I'm concerned the border guard spoke incorrectly. That's resisting arrest, not assault. But they need some basis to detain the guy, so they claimed he threatened them, even though that would be very hard to prove from THIS audio. It all comes down to, do you believe border guards should have extra power oever people and the ability to manipulate what would otherwise be law and personal rights.

By voluntarily leaving your home country, and asking to enter another, you have consented to a search without probable cause or a warrant. Such a search can include a pat down, strip, body cavity, or involuntary x-ray searches.
Technically I believe you can assert that you have changed your mind and agreed not to be admitted to the United States. At that point you can turn around and go home, without being searched or questioned further. However there are consequences--your record will state that you have been refused entry to the United States and you will probably have a Really Hard Time <tm> crossing the US border forever more after pulling that stunt.

I think you have to make that election *before* you are suspected of a crime or violation of any kind. Once they have probable cause to suspect a crime it's game over as they would then have all the usual grounds for arrest no matter what you do.

Well we don't know that because we didn't see the video. Maybe in dodging away he raised his fist or something, maybe he pushed the border guard away rather than pulling away. We didn't see the video.

However from the audio I think they're being a bit overzealous in their definition of assault. Many people will instinctively or reflexivly push away from someone who grabs them violently or unexpectly. Unless he did it in a way liable to cause injury or keeps it up after he's been told to stop resisting I don't think he should be charged with assault.

I have been detained and handcuffed returning to the US, because I have a very common name. This has happened twice.

Seems a man my age with the same name was wanted both times.
Turns out I did not match the description both times.

The officers were always polite and never threatening, but then again I also was polite and not threatening.

One time I asked my cuffs be adjusted and the officer told me he would once I was in the holding area.
Once there he said he would adjust them. I informed him I already did.

Still polite he showed his surprise.

Best advice I can give is just remember to remain calm and polite and the officers will do the same.

The first time this happened I noted several mistakes made by the two officers who took me into custody and reviewed the tape with them and their Captian.

I pointed out several fatal mistakes made by these rookies and asked those deficiencies be addressed.

Good point. But by the way they reacted verbally you'd think he was brandishing a knife at them lol.

In all my trips to the States I've met some decent border guards and some assholes - it doesn't seem to be a pre-requisite for the job. You could say the assholes are just being diligent, but it's more the attitude than the level of scrutiny that can piss you off. Of course, most people swallow the BS and answer all questions right out and move on.

One time my friend and I won a fair bit of cash at the casino in Niagara and wanted to make the most of it by having a good time in New York. The border guard seemed pretty skeptical when we told him we were there for pleasure, but not really sure where we were going to end up. He passed us through though.

Technically, you may be right, but I doubt it. Nor would I want to risk a cavity search by betting on a technicality.

I think the minute you get to talk to a the other border's agents, you are on their territory, or at least in the legal shadow zone that all countries agree are under their control, and they can start to work on you, citing reasonable grounds to search and/or detain.

But I'm not sure.

You're right about the consequences of being refused, though. This guy may get his 15 minutes of fame, as a youtube maverick, but I bet he loses any court cases at the end of the day, and, has trouble crossing into the US for the foreseeable future to boot. Tough spot to be in for some career prospects.

I can see where the guy was coming from, but as the guard said, "was it worth it?".

If you want to dispute the way the guard (or ANY officer anywhere really) is treating you there IS a right way to do it: Comply with all of his demands, do everything he says, answer all of his questions, be calm, do not argue, do not resist. Make notes of what you find objectionable. Once he has done with you, and he has cleared you to go, tell him you wish to speak with a supervisor and lodge a complaint. If it's physically possible instead of telling him you want to do that, pull over and go in and see the supervisor on your own.

Probably still not worth the bother--what do you really hope to gain? But that way you are not putting yourself at risk of arrest or refusal.

You can tell by his accent that he is Chinese, first generation.
I didn't hear enough of the wife's voice to make a determination, but it would make sense.

Did a little bit of search online and the guy's last name sounds English/Scottish. The guy did the recording himself but the agents were probably also recording during the interrogation.

Guy is pretty vocal about his political beliefs, even participated in a provincial election and what he did seems in line with his libertarian/freedom beliefs.
