Downloading Music.

I have to start something here... It is and will remain LEGAL to download music here in Canada. The reason it is legal is because the Federal Government has set up way for Royalties Owners to recover "Potential" losses.

That was in a service charge included in the cost of EVERY Blank CD sold in Canada.

In the US there is no fee included so they are in fact stealing but we Canadians are not!!!

I don't know the ownership of Universal maybe they're owned by Sony or Sony Canada.

And yes the Discs may be cheaper in the US but you have to add in Duty when crossing the border and the tax and the exchange rate.

Oh and hey Denice -I'm downloading music right now, and it's from a Universal Artist!!! Thanks for making the music -my mother always said to say "thank you"!

What a wonderful world it will be when the music companys figure out that they among the living dead. There is no reason for there existance any more. Music should be now purchased on line either from home or a kiosk, directly from the artists website.

Just think, no more idiot music industry execs promoting corporate artists like Spears, In-sync, etc. No more play lists dictated by the music industry. Local talent having a better chance to make it on their own.

Radio stations having to hire DJ's with some intellect, like in the old days of radio where they have to actually come up with some content on their own (Jack FM 92.5 is a ray of hope).

These are all signs of things to come. (Naw it'll never happen! Makes to much sense)

I don't see a problem if music stars become less wealthy. There will always be plenty of people who'd want to become a music star anyway. So the music will not suffer. And if the stars will make ten or twenty times less $$, they will learn to survive. Who really gives a fuck about their financial problems? Not me.

Your all a bunch of thieves, if I want music I buy it, I don't steal it. If you like it, pay for it. Why not go and steal from the gas companies or the banks, etc. They are big companies with alot of money too.

If someone where to download anything from the net, and sell it (or DJ using it -for which recieving pay) -that is stealing intellectual property.

However if it is for personal use IT IS LEGAL.

Here is a way of thinking about it...you buy a set of Good Year Tires -you can give a ride in your car to anyone you want too. As many times as you want too. You can even give those tires away if you choose too. Good Year doesn't accuse them of stealing the use of the tires they made!

Record Companies have gotten used to thinking that they are intitled to your money, and you hould pay what-ever price they want.

As for the stars...at MOST they get 10% of the MSRP of music the Stones and M. Jackson used to get 12% but the rest (after retail is recovered) goes to the Label.

And for those of you who aren't into theft, I just downloaded the new Windows version of Apple's ITunes Music Store and it's phenomenal. They're adding more and more songs everyday, and the interface is very easy to use. The songs we've downloaded are high quality, and Apple won the most beneficial usage rights from all 5 major labels so you're not very limited with the purchased downloads.

the main legal debate in Canada is over whether downloading music falls under a section of the Copyright Act put in place in 1997 to allow people to make copies of music they already own, for their own use.

That section was added to let people make taped copies of their own records or CDs.

To balance out this activity, the government levied a surcharge on blank tapes and CDs, and the money is distributed to artists, publishers and record companies.

But it is not absolutely clear from the way the law is written whether the music that falls under that rule must have been paid for, said one record industry lawyer. "The language is so broadly written that who knows?" he said. "Everyone has a different interpretation of what's allowed."

...so both you and DenWa may be right. It may or may not be illegal.

Winston, you can interpret the law any way you want to! Untill the Courts decide that it is illegal, and move to convict those who DL from the net. I will continue to copy music from anyone who wants to share their stuff, just as I do for others.

This is the same as when we were kids(I don't know how old you are but I'm almost 40) and everyone I knew would tape stuff off the radio, It's the same today. Only we have digital radio.

This sounds like the typical Canadian law: It's legal to have sex for money, it's not legal to communicate for the purposes of obtaining sex for money. It's legal to download music, but it's not legal to share music for download...

The law, being somewhat vague, will most likely be interpreted on a case by case basis. If you find yourself in a courtoom trying to explain why you downloaded 4,000 songs off the internet, I guarantee the law will be interpreted against your favor.

It's clearly not illegal to play your cds for your friends when they come over.

I wonder whether it is permissible to share files via streaming audio, where the file resides in memory and need never be saved to disk? This seems a lot like listening to my friend's cd, except I don't have to go over to his house to do it.

Is this the solution to the downloading debate?

The new Napster service allows you to listen to an unlimited number of streaming songs that are unsavable for a monthly fee of 9.95 USD. Yes, it's legal to listen to your friends cd's when they come over. I believe it would probably be legal to listen to streaming music online, as long as you can't save it to your computer or burn it onto a disc. But the technical know-how needed is significantly higher to set up streaming audio on a website than to simply trade files.
