Harper has no say in it and to speak out against him at this point in time makes no sense.
Hi, what? You do really that the federal government is the respondent in this case? You do realize that it is a challenge of federal law? And you do realize that judges of both the Superior Court of Justice (where the case was initially heard), and the Ontario Court of Appeal (where it is going now) are federally appointed?

Harper has every bit of say in this.

I have no desire to "take up arms" against the current prostitution legislation because frankly, I don't have a problem with it. Outcalls are currently legal. That's good enough for me.

such props help garner media attention. It brings opinions out and causes people to start the discussion. And in this case, the general public has been coming over to the side of legalization more and more. And it is not because they are swayed by the Law Professor's constitutional law arguments.
I would certainly hope it is because they are swayed by the legal arguments involved! Otherwise you are certainly arguing for a truly stupid population.

To my analysis that was JTK's argument that there is sympathy for the legal arguments made and the realities represented, that coming to court in "Bondage Gear" undermines, and indeed there is a political dimension to this case.

When you sat in on the hearings and saw her brandishing her crop in the courtroom (you were there or somehow heard that she had it on display in the courtroom and wore her leather overcoat all day too?) did the Judge ask her to put it away and stop cracking it?
As I already posted she was fortunate/able to get away with it, because these have been judge only procedures and the Judge decided to give her "slack".

If the trial had been before a jury I have every reason to believe that the Judge would have asked her to change or leave the Court Room.
