I like to swear at cyclists from behind the wheel of my car as much as the next person - moreso even, but how exactly is she at fault if buddy in the truck facing her is turning against a red light? Any of the multitudes saying she was at fault care to clarify this one for me?

the truck was turning right, going in the same direction as her

the truck was clearing the intersection like cars and trucks do millions of times a day, light turns yellow, finish your turn when then oncoming traffic stops. she was not even in the intersection yet and said "i think i can make it" and went for it. assuming you have never been in the cab of a big truck there are a lot of blind spots and he most likely did not see her.

if she had stopped when she saw the flashing red light telling her to stop instead of rushing the intersection thinking the rules didn't apply she would not be broken right now. sucks for her but her impatience put her there.

And is it correct that the police have cleared the driver? If so, regardless of left-right, green-red, that is surely definative.

i am not sure if they have or not, even if they do she will sue the truck cuz they are big and scarey and dangerous when you jump out in front of them in their blind spots and they don't see you.

There is a very good reason cyclists are not allowed to cross at pedestrian crossings unless unmounted. Bicycles approach at a much higher rate of speed then pedestrians. When you are making a right turn, there are a LOT of things to watch for, when you have checked to ensure no pedestrians, you need to check for traffic turning left from the opposite side, when a bike pops out of nowhere, one cannot be expected to see it. It is really that simple. I think certain things need be explained to some people who do not drive. A driver can only look at one direction at a time, and if you place yourself somewhere you are not expected to be, you MAY DIE.

Thanks, now I get it.

So the truck was making his turn and she scooted up on her bike on his inside and she got hit.

It's her fault.

She has to stay in the same lane as the truck and wait for him to turn. He was ahead of her. Just because there is room between his truck and the curb does not mean that it's a lane for her to come up on his inside.

That would be the key thing, wouldn't it. For all the smug snickering about how we demonize the trucker by calling him "oh so scary" and so on, the law is the law. If one of them is found to definitely be at fault, it will be for clear cut legal reasons. And scary or not, if you decide to make a turn without properly checking your blind spot(s), then fuck you. You broke the law. No matter how much of a dumbass the person coming up BEHIND you who also took a chance happens to be.

Just pointing out that the truck was making a left turn, not a right and I rather suspect she popped up right in front of the truck so the driver may not have even had a good chance of seeing her coming.

Edit: I see the article has been updated today to say the truck was making a right not a left. Apologies, I was just going by the original article posted.
And it would appear that The Star was as eager to opine without facts as us TERBians. Thank you for your gracious acknowledgement.

Unless the cop was correct and she was riding in the crosswalk, we're left still in ignorance : Did she rush the light coming up beside a truck that was already in position and signalling, or did the truck driver fail to notice a cyclist he overtook and tried to turn ahead of?

Smartest conclusion: The cop was right, and we'll all drive and bike smarter wherever and whenever for thinking about this one..

^Defensive driving (repeat 70 x 7) In this case she was in the wrong, but it really doesn't matter you know that when it comes to a trailer truck - bicycle collision, the bicycle will loose.

I still can't picture this. Was she coming up along the side of the truck and made a dash to make it across the intersection before the hand stopped flashing? Was she coming the opposite direction (against the flow of traffic)? Either way, she shouldn't have been on the pedestrian crossing and she was probably hurrying to make the light which would make her hard to detect from the driver's seat of an 18-wheeler.

I have sympathy for them both. The truck driver is very lucky that they chalked it up to her riding where she shouldn't. I think it was a bad idea to give cyclists this air of entitlement that if they got hit, regardless of who is in the wrong, the guy driving the heavier equipment gets skewered. Everyone should be careful on the road. But it is far easier for a cyclist to see an 18-wheeler than it is for a truck driver to see a cyclist.

Jeepers creepers, even with cars they say to make eye contact with the driver before walking across a street so that is is understood that they see you. How on earth could someone just assume that they are seen, all vehicles have blind spots, especially transports. If you are dead right in front of them with them being up much higher the likelihood is that they do not see you. I would never want to play games crossing at intersections with any vehicle and always look at the drivers and nod my head in a gesture of thanks when they stop and allow me to cross. I am aware that they see me, but would never just scoot out in front of any vehicle. Walking across is always the best bet, it gives drivers more time to notice you,no matter the size of vehicle. Don't always put your safety in the hands of someone else. They may not always notice.

For those that have never been in a truck it would amaze you on how ignorant and stupid people are. I don't care if they're walking, riding a bike or motorcycle, driving a car etc. they have no respect for others out there. Lets just think about me seems to be the attitude. I drive a big truck too and my attitude is, fuck up around me, you might die.

Not sure why you singled out girls. I've seen more stupid shit from male cyclists, but I've also seen more male cyclists out there than women cyclists.

It's so bad now that when I see a cyclist actually following the rules of the road I want to stop my car, go slap them on the back and thank them.

Maybe it's just where I live but many hipsters seem to carry their better than everyone attitude onto their bikes. Maybe it's that generation who's mommies always told them they were right (in other words, kids these days - wait, am I getting old?).
