Since when has it been possible for private clubs to escape the law?

The 2005 SCC decision narrowly interpreted matters relating to bawdy houses and indecent acts. It did not make prostitution legal (or decriminalized). If I form a "private club", it does not mean that I can buy/sell restricted narcotics amongst members, or have cockfights or serve alcohol to minors.

Whoever is giving these opinions to spas (and Club 121 is NOT the only one to have tried it) needs to give their head a shake and dig out their old law school notes.

In the same way, just because you have a "private" club, it does not necessarily allow you to escape municipal code regulations. Sheesh.

If you're going to try to be clever, be smart about it at least.

Prostituion is legal.
Owning and or operating a Bawdy house is not legal
Living off the avails is not legal

The decision on the appeal is to be handed down sometime in June of this year.I am for one hopeful and optomistic that the 2 laws stated will in fact then be decriminalized. Maybe then we will see places like Club121 in our area. It would still be up to the owner or landlord to want "a place " like that in one of their buildings or properties.

Doesn't mean that the establishment will be exempt from bylaws.

That would go with out saying. Bylaws are put in place because it's easier to regulate the provincial and federal laws by city and province but not to replace those laws.
Actually, it doesn't. Look at how 121, and other "private clubs" like it, have been run. And that's not why bylaws are put inplace.

Club 121 was not upfront about the real place of business they were going to run. I am just saying, if the law goes through, it goes with out saying that they would have to abide by the bylaws. There are many cities in Canada that are regulated more efficiently, with having bylaws pertaining to the federal law against laws surrounding prostitution . (ie) massage parlors. They are required , according to city bylaws to have attendant licensing and have to adhere to the zoning bylaws. If you would be upfront about opening a place right now like Club 121.. There is no bylaws for it , because it is against the law.

Sorry, I have no idea what you are trying to say. But you are right on the last part. There are no bylaws for incalls because it is an illegal business.

That position doesn't apply to Club 121 because they claimed to be exempt from bylaws for a very difference reason.

from what i understood, club 121 was to be Cindy's "out" from the working side of the business. she was hoping to basically run the operation and end her career as an MPA. unfortunately, with the closure of 121 im not sure where she went, if she even chose to get back in the business at all
