100 % wrong!!!! Joint custody is a decision making mechanism re: schools, life support etc., child support is always there, born by the higher income earner. fact: custody does not equal access
Read the words in brackets ! "The child spends equal time with each parent." Therefore both parents are supplying what the court requires for child support. Child support is paid to whoever has the child on a more full time basis. It is based on the persons income, who has to pay. That also could be the lower income earner, who is paying. Differences in income, are applied to misc. expenses of the child, not covered by child support. By a percentage basis of the incomes. You can have shared custody, joint custody, or no custody assigned, in an agreement. Divorce can also be granted without an agreement. But a judge would expect to see one soon after granting it, if a child is involved.
True 50/50 custody is rare, and if it does not apply to the original question, then that person should seek legal aid, as they may owe back child support.
From the Ontario Government
The amount of child support to be paid in Ontario is set out under the Child Support Guidelines. Under the Guidelines, child support payments are based on the income of the person who does not have custody or the person with whom the children do not usually live and the number of children that need support.
Joint Custody: Parents who have joint custody of their children share the right to make important decisions about their care. The children may spend half the time with one parent and half the time with the other or they may spend more time living with one parent than with the other. Both parents remain involved in making decisions about the children. For joint custody to work, parents have to be able to communicate with each other and to co-operate even though they are not living together.
