Cell phone car ban?

They have had a law like that in NY for a couple of years but its not enforced much. You still see people driving around talking on the phone - and by the way they are driving its obvious the cell phone is interfereing with their driving.

I agree with Terbul. There is already a law that covers irresponsible operation of a vehicle. This law is unenforceable, and stupidly conceived. If you follow their rationale, they should be closing every drive thru window, because surely eating a Big Mac while you drive is at least as dangerous as talking on the phone. Also, I guess we're on the verge of outlawing screaming kids in the backseat.

The silliness of the law is exposed in the decisions it's forcing. A mounted GPS is ok. A handheld one will not be. Same for an MP3 player. It's just dumb.

If police see a vehicle operating unsafely they can already charge the driver. Passing a specific law for cell phones is a knee jerk reaction, and possibly some in the government think it's scoring them political points.

The advantage of using existing careless driving laws is that they are general enough to allow the police to address all current and future activities that drivers engage in while driving that may distract them from the task at hand.

The disadvantage is that the law is so vague that it leaves the interpretation in the hands of the police and can likely be challenged very easily. This leads to laws that have to spell it out explicitly, like, "You can not do X while driving", where X is talking on a hand held cell phone, shaving your balls, etc.

p.s...i do sort of agree thou....alot of people can't walk and chew gun at the same time so, drivin and talking may be a little to much for them ;)
