The relevant laws exist for punishing this to an extreme extent, but courts simply do not want to throw the book at these idiots. A Careless Driving charge can be a multi-thousand dollar fine and an optional SIX MONTHS IN PRISON. It is also a "quasi-criminal" offense, so you get a potentially life-destroying criminal record AND your insurance can refuse your claim on the basis of the accident occurring while committing a criminal offense. If only this was ever actually applied people might smarten the fuck up.The only problem with this show is the fact that they do not have the power to stop anyone permanantly. They should be legally allowed to say: no, you're NOT getting your licence back.
Of course instead they make up a whole new anti-cell phone fine that is toothless (2 points and a couple hundred bucks, I think.) What a farce. They simply should have amended Careless Driving (or its big brother Dangerous Driving) to specifically include cell phone use, and start slapping people with $1000 fines for general use and jail time in any case where that idiocy causes an accident.
