If this transaction took place nowhere near a school, religious institution, or where children would be reasonably around AND if the hooker was of age and consenting, should this guy have been charged still?
Of course. They have done street sweeps in Hamilton and Niagara for years and years.

Exactly. Communicating/soliciting have always been illegal. The arrest and subsequent charge would have been no different before C36.
The only difference here is that an opportunity has been created for media and C36 advocates to boast of the 'effectiveness' of the new law for offenses illegal regardless (similar to the recent trafficking busts).

One difference is the swing to the high percentage of men who will be arrested and charged under C36 vs. women. SP's are immune under C36, other than certain communication situations where they would likely just be given a warning by LE and told to move on.

I have twice told police officers what I do. Those two events were prior to C-36.

I was not charged with anything - they did not even try to give me a "You are a victim" chat.

There was always and will always be selective enforcement.

My wife's parents live in Saskatoon and her son lives in kind of a sketchy area in the city.I wouldn't have been surprised, if he had gotten change back.........

I was in Saskatoon for 6 or 7 weeks a couple years ago for work. Some scary looking creatures on the streets out there and lots of them. They couldn't be asking THAT much or they would starve. There were also lots of really nice looking SW there as well. Per capita I think the Toon has the highest rate of SW in North America. It blew my mind how many I saw in such a small town.

BTW, I remember reading about a Saskatoon woman who was selling her 10 or 12 year old daughter to guys for sex. Heard that wasn't as uncommon as you would hope out there. Wish they could have included a death penalty for "parents" who could even think of doing a thing like that to their kids.

We can hope. Let them keep their C36 'sweeps' to the street, and continue charging guys that would've been arrested for the same before.

Discretion is a big part of their job. You are well-spoken and presented. If you looked battered, drugged out or in need of supports, their response may have been different. It also depends if the conversation was in a social context or if they were "on the job".

IMO any John stings will be for the Communication offense..."Everyone in Anyplace" as per C36. Very easy once LE can testify that they heard the negotiation first hand and/or have an audio/video recording of the communication for the purpose of.

The Obtaining offense would be more difficult for LE to prove or sting. LE would have to allow a sexual service to be provided first, then arrest IMO.

To be perfectly-honest ... one of my interactions was "on the job". I kicked a pillow onto a candle (like an idiot), and dealt with the police.

I could've had common bawdy house charges. I just got charged by the hotel for a pillow.

I learned my lesson.

We dealt with the police often in the spas I worked in. They knew exactly what we did. One of the spas I worked in got "busted". The charges for the guys and girls who were there were all eventually dropped but the only reason they were charged was political - not bc they suddenly found out what we were doing. (They read reviews of us here - there was selective enforcement).
