I say .. this is a time for serious action.

Tell your neighbour that if her dog starts to bark you will be forced to listen to really loud country and western music to get back to sleep.

You have a right to peaceful possession and your landlord has a responsibility to provide a safe environment for you. A guard dog poses a danger to all who live in building if they are not recognized as a handler by the dog.


You have the right to expect the right to peaceful enjoyment and if another tenant deprives you of this and after complaints and proof is given to the landlord and it is not corrected you are a victim of a constructive eviction and have a cause of action.

Sounds like her biggest concern is that her garage is being broken into.

Why don't you discuss the noise issue with her and offer to help her pay for motion detector lights, alarms system, etc. The cost for such a system is not much and may be less that she'll pay for a good dog and training.

You can tie in a motion detector light to an alarm, a video recorder, an alarm monitoring system, a phone dialer....

I installed a motion detector light for a friend on the back wall of his garage, and ever since he's had no problems with intruders.

On the issue of the dog, I think that dogs that bark all day or all night are not happy dogs, and you may want to point out to your neighbor that she may be being a bit cruel to train a dog that way...

what they don't know they can't bitch about, raccoon shit carries some nasy bugs. once the shit dries out and gets disturbed you and your loved ones get to breathe it in. trap it, set it free, or kill it in a humane way. Its not like there's a shortage of raccoons.

this is a quick fix, going through city hall will take weeks, :)

Would imagine you could file complaints with bylaw that would eventually get her fined.

Depending on what she sets up in the way of quarters for the dog you might be able to get SPCA involved.

Soundproofing can be done, but is fairly expensive to be done right... you'd be looking at a complete gut and rebuild of your bedroom. I looked into doing it when I was redoing my rec room (as it is under the master bedroom) but settled for packing the joists with Roxul Safe-n-sound as the most economical solution.

Talking to your neighbour about your sleep-issues that would arise from having a dog barking at all hours of the night is probably the best first step. Convincing her to install motion-lights and possibly some sort of security cam as a more economical (and reliable) approach may work.

Thanks all for your advice -it's been helpful. I'm looking into different solutions and no, killing the dog is not an option. I'm also a dog person and have my own dog but she is well-behaved - she only barks at the mailman.:) As far as I'm concerned, it is a form of cruelty to leave a dog outside all night.

I've tried talking to her about it but she seems to have made up her mind. Unfortunately they are your typical white trash, we're going to yell at each other (outside) and honk our car horn at 8 a.m. if we damn well please kinda people. She doesn't seem like the sharpest knife in the drawer. My house is owned but they rent so perhaps I should speak to their landlord. I don't think I can do much though until they actually have the dog and if/when it becomes a problem.

Actually, huskys are bred for the cold climates and sleep outside all night in the arctic just fine. In fact, bringing them INDOORS isn't healthy for them....

As for fighting the noise: Gimme a break with all the long process crap. When the dog's barking, call the city noise complaint line. The cops show up and issue a warning to the owner.

Call again and she gets a ticket ($128.00 I believe).
Call again and they get a subpeona to appear before a judge and explain why they haven't muzzled the dog.
Call again and they get thrown in jail for contempt of court/ignoring a court order.

I believe there are fines over and above the jail time for the last two.

The above was explained to me by a city bylaw officer and a cop who responded to my noise complaints from the building next door.

What you COULD do as a preemptive strike is to post the city noise by-laws on her front door. I found that worked twice for me.

PM me Ms Croft if you want a copy and I'll email it to you.....

Just thinking outloud, I believe there are bylaws in regards to "guard" dogs. As they can be construed as lethal weapons I don't believe anyone can just get one. You might also want to bring up your neighbour's intentions with her landlord. He/they might have a problem with her plans......

Another way to go is to get an alarm for her.

The monthly monitoring fee should not exceed $30/month. She will more spend that feeding the dog.

Alarm installs are generally free for a small home and certainly free for something as simple as a garage.

Have a candid discussion with her tell her your experience so far and your future concerns. Ask her to please consider an alarm and then explain you have already done some homework and found out the install is free etc.

Providing a solution for her that helps you is always a good way to go

Based on Miss Croft's description of the neigbour, I fear she wants an attack dog to rip any intruder into a thousand bloody pieces:( . If not, then an alarm should do the job.

Agree that tboy has provided the best advice. Some of us are just having fun with this matter.
