It makes more sense to me that it would be about something goofy.The sheer goofiness about a fundamental constitutional battle over this half-assed shit boggles the mind. I can understand a battle over a weighty moral issue like slavery vs the fact that slavery was the underpinning of the seceding states' economy. If you don't have an issue to believe in, then it is just about whether or not you have the ability to seize power and reset the balance.
If you are challenging the constitutional order for a moral principle then the moral principle might get resolved, defusing the challenge.
