Cheeseburger served with waiver at Toronto restaurant | CTV News

The hilton hotel by the airport served a waiver to a man after he ordered a cheeseburger that he asked to be cooked "medium" instead of well done.

The hotel said they dont normally give people waivers as they always cook their to food to meet the requirements.

As someone who has stayed at this hotel before ; I dont think I could ever eat there again.

Do you think the hotel did the right thing by giving the man the waiver or do you think the guest is over reacting or was his reaction normal?

In this day and age where people blame others for everything that goes wrong and don’t take accountability for their own actions/stupidty, I applaud the hotel restaurant to obtain a waiver. Samonella or E Coli isn’t something you want to be sued over.

I agree with the hotel. Their choices are refuse the customers request or give the customer what they want while protecting themselves at the same time.

Good on them. The customer is an idiot. He requested it cooked that way and then says he lost his appetite because they don’t have confidence in the cooking. Of course they don’t. That is why they gave the waiver. LOL

Yeah i agree.

I usually choose not to eat at hotel restaurants mainly because I have had my food under cooked where I have had to send it back or had it so well done that it was either dry or just not enjoyable.

I think a waiver would take anyone by surprise though. The only time i ever had to sign a waiver was when I was going snorkeling on a resort on a vacation LOL.

I don't disagree with the hotel but the hotel should have mentioned, when he ordered, the reason he'd have to sign a waiver if the burger was cooked to medium instead of after he took his first bite.
I also agree with him, not signing the waiver, the way it was presented to him.

There should be a law against undercooked ground beef. In some jurisdictions you can not serve a fried egg Sunnyside up due to salmonella.

Had they returned a standard medium and said cook it less? That would explain it. Sad such waivers are needed in the first place...

No

He ordered it below the standard temperature that they have to cook it at.

They didn't tell him he would have to sign a waiver until after he got the burger and took a bite.

The restaurant cannot escape legal responsibility by having a customer sign a waiver which removes their liability if they serve food which violates food industry and public health standards. The restaurant should have know better and cannot defend themselves by following the customer’s dangerous request with a waiver which would not stand up in court.
It sounds like the restaurant did not get legal advice and Public Health would not support the waiver if the customer became sick.

Yes that's what I was thinking. If somebody gets sick it is still the restaurant's/ hotels responsibility & they should still be liable.

That waiver meant nothing...hotel could still be facing fines and lawsuit for serving what is considered at risk menu...

Now that's ridiculous. I have 2 sunnyside up eggs for breakfast nearly every morning and never had salmonella from doing so.

I'm sure I'm not alone in remembering when we were kids and our mothers let us lick the beaters after she was finished mixing the batter. Always uncooked eggs in the batter, and never got sick. But then again we 1970 kids were a tough lot.

Salmonella is more from contamination on the shell as I recall...It's all in the handling.

Of course Rocky Balboa used to eat them raw....So there's that.

Their is also the Food Handler’s Certificate for Ontario and Public Health which might consider handing out a waiver a serious violation.

I would never purchase and consume food with a waiver from the restaurant.

Yes I am well aware of the food handlers certificate as i do possess one myself. That is partly the reason why this article shocked me so much. If a restaurant or business knows that they should not serve raw / undercooked meat due to the potential illnesses & health risks it can give its patrons, why would they not decline & say that they have to cook it to the health boards temperatures?

The thing is they gave him the waiver AFTER they had served him his order and already taken a bite out of it.
