Excellent article, glad to see this case set precedent in small claims court. Who knows, this may lead to full decriminalization of providing and procuring companionship services in the future.

Of course, the politicians and religious/right wing nut bars will make a crap ton of noise hiding behind "won't someone think of the children".

I wonder if the reverse is enforceable, i.e., giving money and not getting sex in return, because if so I have a lot of women to sue.
Caveat emptor... lots of precedent there so good luck with that.

it is mainly not even about getting sex in return but the fact they had no intentions of giving service at all, and once they take the money they say they will call he police or worse that they work for the police which is impersonating a police officer

This is nuts. It can't be a legally enforceable contract because it's only legal on one side of the transaction ( the provider's). No such agreement under Canada's current flawed statute amounts to a legal contract. That's the asinine stupidity of the "law" in Canada. The provider may have been awarded her money, but not on the basis of this being a legal contract.

Not so long ago, paying upfront was extremely rare.

I have seen many dozens of SP's and only a very few requested money upfront. I never went back to those few that requested it.

In fact, I was finished with an SP one time and as we're laying bed relaxing, she tells about the guy the night before that ran off without paying her.

I had not yet paid her. I was shocked at that, but it's the perfect example of past times.

It's only because of all those white-night punters that enforce/encouraged paying upfront that has allowed all of these scammers to get a foothold. If we do not pay upfront, we do not get scammed nor do we have law enforcement questions.

Just saying!

I think this is a little unfair to ladies who ALSO get scammed by providing services and having men run out without paying like the lady you stated seeing. Unfortunately scamming people seems to be more common these days than in the past. Yes scammers have always been around but it seems more people are interested in quick easy scams than actually putting in time and effort with anything anymore. So instead of blaming the ladies that try to enforce paying upfront, maybe blame the assholes that expect to get services from a SP without paying them. Just a thought.
It’s not our fault we’re trying to protect ourselves as well. Try thinking about it from both sides instead of just your own.

Or maybe also take into consideration women who have been assaulted by men who refuse to pay.. or men who claim to be clients just to assault or rob the woman. It happens more often than some of you may think.

I am not saying anything other than the reality of times not so long ago, and how the current scammer situation is exacerbated by the whole pay upfront thing.

There are always two sides to every story, however, this all assists the scammers.

That's all I'm saying.

I hope this stands to remove the silly law saying that it's legal to sell it but not legal to buy it I mean this precedent should either cause it to be overturned or this precident will get tossed, maybe escort escrow services lol. New venture.

This is 100% the dichotomy here. In enforcing contract law, the courts have forced this man to commit a crime. Now, i apprecuate that the man intended to commit tge crine anyway but ypu cannot have the courts force spmeobe to commit an illegal act, especially against their wishes. Change the law for sure but lets not start allowing judges make citizens break thr laws that they are upholding!!!

This can't be a legally enforceable contract, because statute law has defined the sale of sexual services as illegal on the buyer's side. So it's no contract at all. The court may have awarded money, but the award can't be predicated on the existence of a contract, because there is none.

I'm guessing that it's an illegal contract, but the law presumes that the girl is "exploited".

There are cases which say that the protected person can sue to enforce an illegal contract, but the other party cannot sue.
