It was for a long time, while the Constitution and the Supreme Court was in effect.
My point was not to look to the courts for individual freedoms. The legal system always serve the ruling class.
You say you lived under the Soviet Union. You should understand this better than any of us.
By definition, Russia / the USSR doesn't have a legal system. It's not supposed to function as a genuine justice system, but a weapon of the kleptocracy.

Let's do it this way, Danny: If Trump is a super-rich guy, why is he being cited for contempt of court to the tune of $10,000 per day. Doesn't that - and any # of other examples - refute your proposition?

I find people who bring up slavery or the lack of universal suffrage during the debating and ratification of the US Constitution to be, to put it plainly, morons. The document was written in a different era, yet the Framers included the process to address the changing times and evolving society and that has been exercised 27 times- including dealing with slavery. The legal system in general favours the wealthy, but where the US Constitution differ from others is where it spelled out what the state MAY NOT do. The constitutional laws did not exist in the Soviet Block- they all had the document called the "constitution" but it was laid down to suppress self determination and served the same function as the words "people's" or "democratic" in the name of the countries- in one word a sham.

Well, thank you for that. Calling someone, who has a different opinion moron, pretty much ends the conversation. I expected better from you.

That is more or less what I said.

So called conservatives believe in strict constructionism of the constution except when it suits them to ignore strict construction. They also believe in states rights except when it suits them not to. Hence because abortion is not mentioned in the constitution it cannot be protected. I cant remember which article or amendment are computers, cars, television, the interne referred to in?
"Strict constructionism" and "orignalism" are just rank bullshit.
I don't think people even pretend otherwise anymore, do they?

None of that changes the original point that the Court has been reactionary for most of its existence.

I did not call you a moron nor was it my intention to offend. I call morons all those who would apply today's standards and cultural norms to the societies centuries ago.

I will take that at face value.

In reality, we agree. My thesis is that we should not look to the courts for individual freedoms. The constitutions and courts in the Soviet Union did not give guarantee individual freedoms, neither did the Constitution and courts in USA.

You have obviously never read any decisions of the SCOTUS or listened to some of the Judges, the recent ones having been proposed and vetted by the Federalist Society.

I think the thrust of that quote is that they are equal in the eyes of the Law, not that they all drive the same cars, Dutch.
Technically, you're wrong. Equality before the law is dealt with separately in the 14th amendment.

But the justices and judges from the Federalist society know it is bullshit.
It's all "wink and nod" justification.

The Preamble is the general statement. The 14th A provides concrete examples.
