The judge is right and if someone did die from attending the party, throw the book at that fuckn idiot host. We are all suffering from this and let’s all do our part and contain the spread of Covid-19.

For this to stick it’d have to be proven “beyond a reasonable doubt” even though one can never really pinpoint where they catch something 100% because you can catch anything at anytime anywhere.

But it's those extremes that this is needed for. It's not for the family that has grandma and grandpa come over, the police dont have the time to enforce that. It's the house parties that have been broken up. It would be next to impossible to prove someone got covid from that specific gathering but if that threat means the party is cancelled because they idiot organizer doesnt want the hassle and expense of fighting it, then that's the key.
Common sense clearly isn't working for them

We could use the Swedish model and just put them in jail for 6 months. That seems more reasonable than making a manslaughter case. which is incredibly hard to prove. Proving they had more than 8 people there is much easier.

so by intentionally and ILLEGALLY putting someone at risk of death when you KNOW that there is a reasonable risk, I would think therehas to be some serious penalty involved?

Yea - they have been saying that fines are not worth the paper they are printed on, no one is going to go to jail for breaking the order, courts are so back logged, blah blah blah.

But.....

Provincial court Judge Ellen Gordon chastised Mohammad Movassaghi this week as she sentenced him to one day in jail, a $5,000 fine and 18 months' probation.
I guess that theory didn't work out well for this guy

The irony is that even on the off chance someone else tests positive its a simple defence to say the dead person was patient 0 and infected the other person while at my party

People are out and about flaunting lockdowns and public health has ceased contact tracing

Well, people never get sentenced to "just a fine". It's always "$1,000 fine and in lieu thereof 10 days in jail" or something like that. In Provincial offences, they may / may not overtly repeat that formula because there's a section given the conversion rate of days in jail per $100 of unpaid fines.

So he'll either pay the fine or do the time. His choice.

You are correct, precedence has kind of been set by the provincial government since WSIB has denied claims of people who say they contracted Covid at work.
If thy can deny that a single person who only goes to work and gets groceries once a week contracted Covid at work and their only contact tracing was people from work, how can they convict someone of manslaughter for a party they threw with a person who contracted covid after that party.
