Phoenix Felony cases with major actions in March 2017 (Partial report had done on local boards more results earlier in March)

Never discuss or offer sex for money. Here are latest of the zillion felony cases I am following in Phoenix to warn others about the legal situation and the importance of the current ESPLEP case at the 9th Circuit challenging the prostitution law. Too bad we don't follow a harm reduction model like in Canada vs increasing harm by the criminal legal status which results in failure to report bad things to LE.

Reminder that almost all cases take pleas for a felony but probation vs. potential decades in prison if found guilty at trial since most charged with criminal enterprise, money laundering etc. Often the prison term potential is far more than for violent crimes with "real" victims. For example, Tracy of Goddess Temple was warned by judge she could face 40 years in prison if didn't take a plea. She lost at trial but due to judge sentencing all the many counts concurrently was only sentenced to 4.5 years in prison where she now sadly resides. The other 37 defendants took pleas for probation. All cases are for in private consenting adults.

Both for privacy and easier to track I am starting to use Defendant numbers given by the court instead of first names.

Relaxation Station
8 indicted, 1 outstanding arrest warrant. 3 have taken felony pleas. The rest have their cases continuing.

Def 08 sentenced to 2 years supervised probation on felony since had keys and was a receptionist. Undercover also got an offer for a hand job. Did traffic stop on two leaving customers, one admitted to a HJ and another denied any sex took place. As she said in her presentence report "There were no victims in this matter."

Def 01 pled and sentenced to 18 months probation for facilitation to commit illegal enterprise.

Def 07 took felony plea in March. Sentencing 4/25

Next Conference 4/11/2017 for those not yet pled. Except Def 04 and Def 06 for 4/4/2017

5 indicted - 3 pled from earlier reports and in March 2017 final disposition on last 2 with charges dismissed. Very odd to have dismissed and no details why in the court record.

Latest: Male owner 3 years probation.
Def 03 was receptionist and sentenced to 2 years probation on felony
Def 01 Felony plea insisting just did body rubs nothing sexual. Sentenced to 2 years probation
Def 02 Had worked at Spa for less than 3 months, took felony plea with 3 years probation.

Bust was the result of an anonymous complaint on 9/24/2015. LE got a customer to admit his penis was touched for $50 and a undercover got a handjob.

Felony plea deals except for one just now arrested long ago but sentencing is delayed with ongoing trial of owner. Some have testified for the State at owners current trial.

Defendant 10 arrested and pled. All have sentencing date of 4/5/2017 but probably will keep getting continued until owners trial is over.

4 indicted, 1 pled so far: Def 02 pled to felony and sentenced to 3 years probation.

Next conference 5/4/17 and scheduled trial 8/2/2017 (but trial dates often continued sometimes for a year or more trying to get more pleas). Case is young with arrests in May 2016 after a 9 month investigation and 1700 pages of initial State discovery.

Chandler Massage House
Disable, retired elderly man modified a bedroom in Chandler home for massage and rented it out and split fees with a worker. Pled to house of prostitution felony and sentenced to 2 years probation. The presentence report recommended sex offender status, but this was not in the final sentencing.

I don't know if any workers got charged since probably only misdemeanor prostitution. I only follow the felony cases in Superior Court.

This case is from 2015 Wife pled to felony in 2016 with 2 years probation but husband failed to show up for trial and arrest warrant issued. Arrested and initial appearance on 3/30/2017. Next hearing 4/10/2017

From 2015 raid. Worker took felony plea in 2016 with 2 years probation. Owners case continues with pretrial 5/11/2017 and trial scheduled for 5/18/2017 but all dates often continued.

Odd case lots of probable cause with undercover's offered sex and search warrant seized computers and tons of stuff. However, there seems never an arrest and no further court record other than the 2016 listing of defendants and the search warrant.

On Google reviews, as of 3/31/2017 has a review "2 weeks ago" saying had customers inside and strippers outside smoking but when asked the dancers they said they were closed. Asked when open said they are always closed. Still has website at https://www.sunsetstripclub.com It was well known as a ripoff place.

Some of Trump's picks suggest otherwise. Pence, Sessions and Gorsuch are all proto-conservatives (fundamentalists). The only positive is he didn't pick Ted Cruz and Rand Paul.

Gorsuch believes in a medieval ideology, that doesn't bode well for Roe vs Wade.

Trump is more open-minded about sex compared to other republicans. He speaks openly about sexuality and he isn't very religious. So I think he would be more open to the idea of decriminalizing sex industry.
Federal government has nothing to do with it. It's state law.

When I worked in Austin I had a couple of warnings... one from another provider and one from a client. It scared me shitless.. That said, I do find American clients to be quite careful and very willing to give references and other information, unlike Canadian clients.
 
The chances of Hawaii decriminalizing is zero. One legislator proposes bill as in NH and other states to decrim and it goes nowhere or overwhelmingly defeated. It is accepted it would be political suicide to support legal sexwork in the U.S. for at least in this generation.

Trump can't do anything and doubt would. In the U.S. prostitution and criminal enterprise felonies are State laws not Federal as in Canada - other than some Federal sex trafficking acts and Mann Act. But almost all prostitution related charges are under State laws.

Simple prostitution is a minor issue vs the felony cases I report on when someone has a helper, driver, phone helper etc. When two or more folks involved its a serious criminal enterprise felony and every time money is deposited in a bank it is a money laundering felony. A felony means no gun s (which I support anyway only the cops and miliatry need assault weapons and guns should require licensing like auto licenses), A felony means potentailly many years in prison under mandatory sentencing. For example Goddess Temple judge had no choice below 4.5 years in prison under mandatory minimum sentencing in Arizona (similar in most States). A felon can not vote and if commits another felony within 10 years is not eligble from probation and longer prison sentence. Prison for felons is far different than "jail" for prostitution misdeameanor. In Arizona prostitution results in mandatory 15 days in jail on the first offense - not years in prison or years on probation as a felon. In Phoenix we have our infamous Tent City with our former long-time Sheriff Joe (now out of office and new Sheriff may close Tent City. But its still only jail not prison with dangerous criminals

The only hope and a slim one is the current ESPLERP case now pending at the 9th Circuit based on Federal Constitutional challanges to the prostitution law, similar to the Canadian fight that was eventually won. Regardless of the outcome may go to the U.S. Supreme Court. That is where who Trump gets as judges is critical. Some of the arguments in the current case are based on the U.S. Supreme Court lawrence vs Texas case years ago. The Supremes on a split 5-4 decision said laws can not be based on morality and the State has no business in the private bedrooms of citizens.
However, this was a case about gay sex (sodomy law) and did not address paid for sex. The current cases argues many elements beyond just the Lawrence case and in my view is very well argued.

One key in the U.S. is "compelling interest" which has always won on the side that having prostitution illegal is a "compelling" State interest to reduce STD's, other crimes, danger to community etc. We ignore "harm reduction" which won in Canada that making it illegal increased harm potential and is why most cities are not enforcing C36, if no "harm" i.e. private consenting adults.

Why don't you travel to Germany , Australia or New Zealand where the sex industry is legal ?
I have considered and explored options. Problem is LONG flight - I am 6'1+ and direct flight to Toronto is long enough! Also costly airline fares. When I went to Thailand and Phillippines long ago EVA Air had great Evergreen Deluxe class great roomy seats not much more expensive than coach, but those days are over. I have watched some of the European discount airlines but still long flight and almost none direct from Phoenix still very costly compared to Air Canada Rouge to Toronto.

Also I like that I know Toronto so well and have friends I meet for dinner etc. I basically know the roads, the agencies, the nude-reverse rubs and the strip clubs in Toronto/Hamilton/Niagara from about 20 years of visiting. I still use my GPS but not like going to new virgin area.

Some places in New Zealand especially sensual massage options I have liked. Maybe someday if not too old but have limited time to be away from business and am not wealthy so have to watch costs.

Going to Europe basically takes 2 days to travel to and from vs 1 to Toronto and can land and still go to my usual first stop before they close - Club 2 Mountains only place I walk in without specific selected gal and appoitment but always have great time. For 2 years I noted the door said they close at 3PM (instead of AM) but last trip no hours on door.

If they are correct in their appraisal, and Gorsuch is the proto-conservative they make him out to be, Roe vs Wade will be repealed.

How can he repeal what is the law of the land without another case to overturn it? Doesn't there still have to be a majority of more than one judge to overrule?

They will create a case. Some sheriff in a redneck state will go charge a doctor at a Planned Parenthood clinic with murder. A redneck local jury will convict. The doctor will appeal the conviction to the Circuit court and win. Then they'll appeal the Circuit court ruling to the SC..

Smoking Weed is legal in some states but other states it could give you 10 years in prison (double standard much?)

USA make the most and best porn movies, yet prostitution is not legal, exept some area in Nevada where oh surprise it is... because...???

At some point i think this country should get his shit together and have laws being the same everywhere, and double think on some laws as well.

Canada is not perfect but at least here the chances of prison terms for weed (unless your a huge dealer) and prostitution are pretty much 0.05% Worst that may happen is you spending the night in jail...
