One problem....

The alleged abuse occurred on the first date only.

So how could he know they were gold diggers on the first date?

He did not continue to abuse them after the first date, even they admit that. He saw Lucy on and off for a couple of years (albeit very casually). So again, how bad could it have been?

The third witness gave him a hand job on their second date and then told him to hit the road when he made disparaging remarks about one of her friends. The alleged abuse didn't motivate her to ditch his ass, but him dissing one of her friends sure did.

The only witness who even has a shred of credibility is the first witness, the other 2 are complete farces.
There were a lot more than these three. He himself showed CBC videos of a woman he beat so badly he broke her ribs, but he also showed them what they agreed was consent from her.

Seriously, when you are dating a gold digger (or in his case celebrity ladder climber) you KNOW. They generally don't give their ambitions. When I was dating on PoF I used to seek out the gold diggers. Once they establish that you are successful you can fuck them easily on the first date.

Unfortunately some of the posters on here are too close minded and set in their own ways to differentiate between consensual rough sex and beating a woman. What he did to his accusers was consensual rough sex and is not considered beating someone up. There are many people that are into this type of sex act and it certainly is not illegal.
Whether you agree with what he and his accusers did consensually is irrelevant and does not matter. The accusers have been caught lying and I don't have any sympathy for them any more. At first I actually thought with the numbers of accusers that maybe this guy had done this to the girls, but with all the evidence presented it's very hard to think he has.

What is disturbing is how the investigators didn't do their due diligence to find out the full story before proceeding with the charges. The fact that all of the 3 witnesses did not fully disclose the full story of what happened after the alleged sexual assaults is and should be a big part of the case and so is the 5000 text messages between the 2 witnesses these are all things that are relevant to the case. Thanks to these incompetent investigators they have a ruined a good broadcasters job.

Exactly this. There are too many trolls on here just arguing with one another and continuously posting in threads trying to prove their point, and trying to bait one another into arguments. And it's usually the same clowns.
They must live very exciting lives to be able to dedicate so much time into baiting and trolling one another.

Call it what you like, a guy who gets off on beating up women is repulsive.

This pretty much sums up everything we need to know about you fuji. Of course, if you were honest with them they would have nothing to do with you.

Call it what you like, a guy who lies to get sex from women is repulsive. Physical violence or fraudulent manipulation - take your pick.

The "real" issue in all these and similar cases is quite simple to state, quite difficult to resolve: Who is abusing whom?

Emily Browning (btw, recorded by The Eurythmics many years ago):
...Everybody's looking for something
Some of them want to use you
Some of them want to get used by you
Some of them want to abuse you
Some of them want to be abused.

Perry, I'm very surprised you sort of defend this guy. Doesn't sound like your style, but maybe I'm wrong.

It totally makes sense that these women continued contacting him after he beat them up. He was a celebrity, he was their ticket, they thought their relationship with him was their shot. That means they were basically gold diggers who thought they could fuck their way to the top, and he knew it, he took advantage of that to abuse them, knowing that they would put up with anything in order to climb the ladder they thought he was providing. When he withdrew the ladder they were enraged, they suffered that abuse for nothing.

Is that criminal? Judge will decide. But it sure is repugnant.

Fuji, you have nailed it down!

Fashionboy reminds us of the Supreme Court's decision that advance consent doesn't negate a crime of assault, but IMHO that decision only applies when the specific facts of a new case are similar.

When there's no physical proof of an assault, is rough sex assault when both parties admit to it?

Assuming rough sex is a given, does this mean that reconciliation, between two people who are free to be together or not, negates any chance that it was assault? (We aren't talking about consent given before an incident of unequivocal assault later, which the Supreme Court says is not consent and therefore a crime).

I have had a bit of time on my hands these past few days so, every once in a while, I catch up with the running reports of the evidence on The Star...

Let me say (without bragging) that I "have been around" when it comes to trials, etc., and I have seen and heard the very best trial lawyers at work .... and what I want to say is that, based on what I have been reading, Marie Heinen is a masterful cross-examiner and tactician. Cross examination is a difficult art and science that not many lawyers -- not even highly experienced ones -- ever master.

(Not sure if this is the book I have in my library on the subject, but this one's a classic).

Actually it's more complicated. Beyond a point it could be viewed as assault in the eyes of the law, and the Supreme Court has said you can't consent to assault. In other words, even if you say "Yes I want it", it's still illegal and punishable by law. I believe this is why M. Henein chose to discredit the victim's testimony and recollections, and downright honesty — because if she can suggest that they are lying, then then assaults never happened, and Ghomeshi is safe
No, you are right. When does what 2 consenting adults agree to stop becoming legal, and becomes assault.

NHL hockey is the same way, all parties agree to the fact they could get into a fight during a game. But what if some goon beats the pulp out of another player to the point where he's in a coma in the hospital for 6 months. This is no longer a game, this is now a criminal offence.

But I still think the woman in Ghomeshi case bears some type of responsibility. If you're into guys beating you up, you should know things can get out of hand very quickly and whatever happens because of that is partly your fault

He's not defending Ghomeshi the person, he's defending the letter of the law

Really ! just remember the letter of the law. Violence is unlawful even if consented upon.

For once fugi and I are on the page about a topic, and he gets himself banned. Fuk !!!

I am not defending him, I am not accusing him.

In fact, I really don't know what happened because I was not there and I don't find the evidence I have read about so far to be persuasive -- so I don't invent facts and then jump to conclusions based on them.

Least of all am I inclined to "decide" anything or jump to conclusions based on newspaper headlines, rumors or untested allegations.

We have a legal system and we have a process. I don't really like the system; I don't think it is very good; it has lots of defects. But it is the only system that we have and, until we replace it, I will play by the rules we have all agreed upon.

I am not into BDSM. I am into romance, candlelight, wine, ganja and soft eroticism so I have no experience with "rough sex" and am not in any position to pass judgment or even express an opinion on what others with much different tastes and predilections might do.

You seem to be one of a kind in this thread and most of the others as well. I must say i do appreciate your posts and have probably learned a few things about the law from reading them.

Well at least we are on the same page in that respect, there is nothing like spending quality and sensual time with a graceful woman. Nothing!
On your beliefs I sort of do agree, but there are three women here involved and I can only imagine the line up behind them who refused to testify. As story goes.
Perry if smells and acts like a pig, it must be a pig. I know your following the rules of law. And as you said, its not perfect.
Right now, I'm just curious about the judges decision.
