  • Saying that football player Brett Favre is retarded, instead of retired, and insiting that Favre goes back and forth from being retarded, to not being retarded, then later points out "...if he's not retarded, then why'd he take a picture of his ding-a-ling?."
  • Mistakenly says "he finally divorced Ellen DeGeneres (Elin Nordegren)....that was never going to work, 'cause, you know, she's Lebanese (lesbian)" from Tiger Woods' divorce.
  • Incorrectly states Prince will.i.am (Prince William) married Kate Gosselin (Kate Middleton) from the wedding of Prince William and Kate Middleton in 2011. He then says "that's why everybody was so upset that he didn't invite Fergie."
  • Claims that the Protestants (protesters) are trying to occupy Walgreens (Wall Street) because they want 99% off from Occupy Wall Street.

A few years ago (give or take), he was explaining how he finds women to bed. I believe the thread was about pick-up techniques.
I don't believe in that PUA stuff, so no.

My guess is that you have never had to deal with an Insurance Company, other than paying a premium? I can guarantee that this will not happen. I'm no fan of the Insurance Industry, but what you are suggesting it that out of the goodness of their hearts, they would retroactively reinstate an expired policy, just so they could pay the OP's claim... Not effing likely. I think a more likely response is that the company will choose to NOT reinstate the OP at all. The like "easy, responsible" clients and would like prefer to avoid insuring this one

I would add that I can totally understand the OP's predicament. Difficult choices sometimes are not made correctly. Mercifully, he didn't have an accident and hopefully will learn from this.

My wife was involved in a hit and run (almost head on at an intersection). It was then we found out from our broker an astronomical amount of people drive in the GTA without insurance. Despite your personal circumstances (had to choose between paying the mortgage/putting food on the table), you made the concious decision to drive while uninsured, in a city that has a great public transportation system. I hope you get what you got coming!

It took an insurance broker to tell you people are driving around this city without insurance?

how does this relate to your wife being involved in a hit and run in any capacity? and how does him driving without insurance effect your life in any capacity???

You go head and keeping breaking law by seeing SP's not to mention cheating on your wife, and keep judging someone that didn't do against the law. I hope you get what's coming

Like I said, your best shot is to get the charge reduced to failure to provide proof of insurance. Tell the prosecutor there was a lot going on in your life and you just dropped the ball. Tell him you know it is a serious matter and it was just a mistake. If you have any past instance stubs or proof of payment take them in and show you have always maintained insurance in the past. Spin it as an administrative error that you corrected as soon as you realized your mistake. If your record is otherwise spotless this counts as a minor conviction and will not have any impact on your insurance. But best to not try an change insurance companies for at least 3 years.
This is the best advice so far. Be penitent and hope for the best. A good portion of the judges dislike the $5K penalty and revise it.

And since when are "Judges" sitting in Provincial Offences Courts?

Finally, while I am not up on any case law regarding this charge in which the fine was lowered, the statute prescribes a minimum fine of $5,000.00 plus 25% victim surcharge etc.

But again, back to my original question:

What is the 800 lb Gorillia in the room?

The 800lb gorilla is that he is totally guilty and has no hope is beating this in court, the facts are he drive without insurance and the prosecution can totally prove that.

The only way he beats this outright is procedural error on their part, or someone doesn't show up in court.

Pleading down to a lesser offense is likely possible just because the prosecutor saves some bucks not having to prepare and show up. Many people are successful getting tickets reduced just to save the prosecution time.

But if he fights this, the 800lbs gorilla is he has no defense, he is guilty as sin.

Aside from your morally judgemental "guilty as sin" prejudice, all that matters to the OP's insurance is whether a conviction, any conviction, is registered.

That is just not true. Many insurers overlook a single minor ticket. If he gets this reduced to a minor infraction and his record is otherwise spotless it will have very little impact.

If he is sitting on a raft of speeding tickets and now this, well sure it will impact him: the system works...

Get over it. He is guilty, it is a fact. He admitted to driving without insurance.

He has a good chance of pleading down and a small chance of no one showing up in court, but no chance of beating this if the prosecutor shows up with a case.

I have given evidence in these trials and seen judges knock the judgement to $1000 in one case & $1500 in 2 others and twice at $5000.

Judges have a tremendous ability to tell anyone else to piss off. Ask Harper and his minimum mandatory sentences and how that's working out
