Here’s CNN to explain:

The reserve deputy who shot a suspect with his firearm rather than his stun gun, and another deputy who can be heard cursing at the suspect after he was shot, were not in their normal states of mind because of the elevated stress of apprehending the suspect, according to a Tulsa, Oklahoma, investigator.

Tulsa Police Sgt. Jim Clark, who has been brought in to review the case, said Tulsa County Reserve Deputy Robert Bates, 73, "inadvertently" shot Eric Courtney Harris after Harris -- a possibly PCP-addled felon who had days prior sold methamphetamine to an undercover officer -- ran from authorities after trying to sell an illegal handgun during an undercover sting.

As deputies tried to handcuff Harris, Bates arrived with a pepper spray gun in hand. He warned his fellow deputies he was going to use a Taser on the suspect, but instead, he fired a single gunshot -- and immediately apologized, Clark said, citing a recently released video.

Mens rea, that it was obviously accidental does make a difference as to Criminal Charges. However, there is certainly going to be civil liability.
Only a sleazy lawyer would make it a defense, that someone "by mistake" fired a gun instead of a Tazer. Come on, a trained LE officer.

I will try that next time: "Your honour, I thought it was my sons toy gun I had in my hand"

i wonder if any criminal used the defense, "i only shot the person because i was outta breath and full of adrenaline and therefore my judgement was not right..i just wanted to shoot him with a watergun..i swear" ... it would be laughed at in court..

When did deadly force become an acceptable tactic for police who need simply to stop a non-violent suspect guilty of a misdemeanour at most. He left the car behind, surely it would hold all the clues any officer with as much brains as testosterone would need to calmly track the guy to his home. Or wait for him at the impound.

But just imagine if Frank the Fleet-foot had bought into the crap doctrine that Everyone Carrying Makes Everyone Safer. The officer might then be a legitimate hero. But a dead one. Still, the department would still have its Taser™.

To paraphrase the ever-wise Asterix, "These Americans with their guns sure are crazy."

Here's a brief transcript of the mans last words before he died and the cops response.

Bates immediately apologizes, saying, "I shot him. I'm sorry."

Harris, who is bleeding, calls out. He's been shot and didn't do anything, he says.

An officer yells at him, "You f**king ran! Shut the f**k up!"

"Oh my God, I'm losing my breath," Harris cries as a deputy's knee pins his head to the asphalt.

"F**k your breath," an officer tells him.

Thanks for pointing that out; by the CNN account, it's still in no way a justifiable response to any sort of real threat the victim presented. What it does read like is an enraged cop clumsily using whatever was the most force available merely to end resistance, and who cares if that's deadly force which kills the guy.

Are you writing about the same incident?

It states right in the quoted article that Eric Harris a "PCP-addled felon who had days prior sold methamphetamine to an undercover officer -- ran from authorities after trying to sell an illegal handgun during an undercover sting."

The guy was on the force for what is probably a very long time, let's see what his record is like. I'm gonna guess that this was inadvertent because of this fight/flight syndrome and it was an accident.
Otherwise he would have just stopped running, drawn the gun and shot him.

They charged him so the rest of the city doesn't start causing shit and looting.
