Sounds like the Pan appeal will be based on the wife of one of the jurors, who seemed to be single handedly trying to derail the case. Sigh.

She was attending the case and texting her juror husband stuff the jury wasn't supposed to know about, then interacting with and trying to influence witnesses, including cheering them on in court--until the judge finally banned her from the court room. But the damage may have been done. Judge decided to carry on but that will clearly be challenged in an appeal.

Magnotta's fate is now in the hands of the jury. Husband's fate will be in the hands of the jury later to-day or very soon thereafter.

Both Magnotta and Husband's fates are in the hands of the jury. Both are claiming mental illness. Anybody want to bet that one or both will walk?

They are both going down like lead for Murder 1. My call.

Husband ---- Guilty of 2nd degree murder. That sounds about right to me.

Query: Why is the Magnotta jury taking so long?

I thought it would be Murder 1 as he was packing and I was under the impression that he went looking for his foe to kill him - hence premeditation. The Magnotta trial took weeks or months for the evidence to be heard. It's not unusual for a thorough jury to want to spend a long time rehashing and discussing it.

Yes, he was carrying a gun for protection but it was just an unhappy coincidence that he ran into the other group at that time. I think 2nd degree is fair.

There is another interesting court case in Montreal. Woman caused the death of two people by stopping her car to help ducks cross the road will be sentenced to-day.

One juror at the Magnotta trial has been excused so he could go on Christmas vacation. What is taking so long:confused:? The guy is guilty as sin. I worry about these Quebec juries.

I think the unhappy coincidence is that Husbands was such a bad shot. Other then the innocent victims, the two intended victims were a public service to Ontario. Personally I think he should have been convicted of criminal negligence, discharge of a fire arm, assault and given a public service award at the same time.

Query: Why is the Magnotta jury taking so long?
On day two of deliberations the jury paused to ask if "personality disorder" is considered mental illness under law. The judge replied "yes".

They are now going into day five! However it's been said that this jury is pretty strict 9 to 5-ers and sometimes even less; whereas most will burn the midnight oil.

I still have a bad feeling about this case; more so now then ever.
